Abstract
This dissertation deals with the question of the child´s legal status in legal proceedings concerning its own person. Special problems that may arise in investigations concerning the situation of the child and in decisions on measures to be taken in the best interest of the child are also examined. The Care of Young Persons Act (1990:52) constitutes the framework of this study. According to the Act, the County Administrative Court shall, upon application by the social welfare board, decide whether the conditions for statutory care are fulfilled. This dissertation deals with the question of the child´s legal status in legal proceedings concerning its own person. Special problems that may arise in investigations concerning the situation of the child and in decisions on measures to be taken in the best interest of the child are also examined. The Care of Young Persons Act (1990:52) constitutes the framework of this study. According to the Act, the County Administrative Court shall, upon application by the social welfare board, decide whether the conditions for statutory care are fulfilled. The law should act as a means of legal protection for exposed children and young persons. The function of the judicial process is to materialize that protection. The thesis examines this function of the law. Three basic demands according to international conventions and Swedish legislation consitute the startingpoint of the work: the child´s right to legal security, the right to personal integrity and the right to successively increasing autonomy. One of the aims of this work is to examine whether the procedural framework for statutory care proceedings according to the Care of Young Persons Act and the practical application of this framework actually satisfy these three demands. Another aim of the study is to describe, at a more theoretical level, the characteristics and special problems in respect of the child´s role in legal proceedings concerning itself. The Swedish legislation is compared with corresponding regulations in Norway and England. An empiricial study based on 390 judgments from the year 1998 in four County Administrative Courts in Sweden concerning statutory care demonstrates how the rules have been applied in practice. (Less)

Vad är barnets bästa i en domstolsprocess? Hur skall barns behov och intressen tillvaratas under utredningsarbete och beslut, och av vem? I vilken utsträckning skall barn få komma till tals, och varför? Under senare år har barns rättsliga ställning inom olika områden tilldragit allt större intresse inom rättsvetenskapen, bland rättstillämpare och hos allmänheten. Sveriges ratificerande av FN:s konvention om barnets rättigheter har bidragit starkt till denna utveckling mot en fokusering på barns rättigheter. Av denna konvention framgår barns rätt till likabehandling och lika värde, barns rätt att få komma till tals och att få påverka sin situation samt barns rätt till skydd vid utsatthet. Motsvarande krav på rättssäkerhet, integritetsskydd och gradvis stigande autonomi återfinns i andra folkrättsliga dokument och i svensk rätt. I boken behandlas barns rättsliga ställning i mål rörande deras person och de särskilda problem som uppstår när det gäller att utreda barnets situation och ta beslut om vilka åtgärder som är förenliga med barnets bästa. Lagen med särskilda bestämmelser om vård av unga, LVU, utgör ramen för de problemställningar som aktualiseras i boken. Lagen skall fungera som ett rättsligt skydd för utsatta barn. De regler som styr förfarandet i samband med att ett beslut om tvångsvård av barnet fattas skall förverkliga det skyddet. Författaren undersöker om roll- och ansvarsfördelningen mellan socialnämnd, offentligt biträde, i vissa fall tillika ställföreträdare, och domstol tillförsäkrar barnet rättssäkerhet i form av tillfredsställande utredningar, motiverade domskäl och välgrundade beslut. Vidare granskas barns integritetsskydd i form av möjligheter att få komma till tals och att få mottaga information respektive i vissa fall få den egna utsagan skyddad. Dessutom analyseras barns möjligheter att utöva autonomi och påverka olika typer av beslut under processens gång genom den egna rättshandlingsförmågan eller genom sin ställföreträdare. De svenska bestämmelserna jämförs med motsvarande regelverk i Norge och England. En undersökning av den praktiska tillämpningen vid fyra förvaltningsdomstolar belyser effekter av det förfarande som föregår ett beslut om tvångsvård. Utifrån dessa resultat ger författaren vissa rekommendationer hur barnets rättsliga ställning kan stärkas i domstolsprocessen. (Less)
