  abstract     = {{The essay examines the applicability of the concept of criminal gangs to the so called autonomous environment based on the bill to criminalize participation in criminal gangs and the accompanying bill for a constitutional amendment that followed as a consequence. Taking the legislative proposals as its point of departure, the essay analyzes the concept of criminal gangs. Subsequently, an analysis of a recent court case are applied with a gathered understanding of the concept to the stated purpose of the legislative proposals in order to assess whether political environments may fall within the scope of the proposed legislation. The essay further evaluates the potential consequences that the legislative proposal may have for freedom of association. 

The author of the essay finds that several alternative definitions of the relevant concept could potentially be realized, and that some definitions contain criteria that may prove problematic for Swedish freedom of association and, by extension, Swedish democracy. These concerns primarily relate to delimitations adopted in other Swedish and European definitions of organized crime, which entail a risk that the scope becomes so broad that it exceeds what has been identified as the purpose of the legislation.}},
