  abstract     = {{This master’s thesis examines the legal conditions under which the Swedish Transport Administration may close railway crossings and how such measures are implemented in practice. The study focuses particularly on the interaction between the Swedish Real Property Formation Act, the Swedish Railway Construction Act, and the property protection mechanisms intended to safeguard individual property owners during the process. 

The study combines legal and empirical methods. The legal analysis covers relevant sections of the Real Property Formation Act and the Railway Construction Act, legislative history, and key case law. The empirical part includes a qualitative review of 24 cadastral dossiers and correspondence with the Transport Administration. The study also has quantitative elements through a compilation and categorization of cadastral procedures to identify patterns in their application. 

The study shows that the Transport Administration possesses extensive opportunities to close railway crossings through cadastral procedures and that there are seldom practical incentives to establish a railway plan. The findings further indicate that property protection has limited significance in practice and rarely constitutes a genuine obstacle to the closure of railway crossings. However, recent case law and the Transport Administration’s ongoing work with railway crossing closures suggest that a shift in legal application may emerge. 

Finally, the question remains whether constitutional property protection, as a potentially more far-reaching safeguard for individual property owners, may prevent measures that are otherwise permitted under the property provisions of the Real Property Formation Act, thereby potentially undermining the purpose of the railway planning process.}},
