The theoretical approach shows that there is a tension between liberal and feminist arguments. This paper focuses on the legislature's earlier arguments in both the issue of surrogate motherhood and prostitution. The comparison with prostitution aims to investigate whether there are other values that the legislature places emphasis on even though there might be similar problems. It appears that the legislature put emphasis on gender equality, exploitation and crime when it comes to prostitution, while the values discussed in the investigation of surrogate motherhood is all about the natural life process, technology and genetics. Although similar problems occur the emphasis is placed on different values and it is therefore time for the legislator to take a broader grip on the issue so that the new investigation is not blind to some implications of surrogate motherhood.
