- Since the European Union’s inception, creating a well functioning, competitive and integrated market has been at the heart of the Unions project. The four freedoms, free movement of persons, goods, services and capital, which led to the opening of the boarders, have been one of the main forces behind growth in Europe. Today, Europe has become the world’s biggest economy and the Single Market is its real growth engine. This thesis examines the field of services within the Single Market. Today, Europe has become the world’s biggest economy and the Single Market is its real growth engine. This thesis examines the field of services within the Single Market. It examines the development of the freedom of establishment as well as the freedom to provide services, guaranteed by the Treaty on the Functioning of the European Union. It strives to give a comprehensive overview of the case law of the Court of Justice of the European Union in this field, how it has interpreted the Treaty provisions and developed concrete rights for the citizens of the Union. Legislation as regards to services within the Union is thoroughly examined, mainly focusing on the Service Directive: what it adds to the law and what it has achieved. Lastly, the state of the Single Market will be examined, it´s benefits, challenges and it´s shortcomings. This thesis endeavours to answer the question why it is not delivering its full potentials. The main findings to that question is lack of consumer confidence, lack of awareness of the rights citizens derive from European Union law and the need for better implementation and stronger enforcement of Single Market requirements.
