- The aim of this essay was to examine and problematize, based on current norms, how female rape victims have been portrayed in different selected judgments. This has been based on the following questions:
- How is the female rape victim portrayed in the selected empirical data?
- Why are the existing perceptions on female rape victims problematic?
The study have had a gender theoretical basis with a focus on the terms rape culture, victim blaming and the ideal victim. The empirical data consisted of nine selected judicial decisions which were analyzed by using a qualitative textual analysis. (More) - The aim of this essay was to examine and problematize, based on current norms, how female rape victims have been portrayed in different selected judgments. The study have had a gender theoretical basis with a focus on the terms rape culture, victim blaming and the ideal victim. The empirical data consisted of nine selected judicial decisions which were analyzed by using a qualitative textual analysis. During the processing of the empirical data six different themes were identified and analyzed. Some of the most important result in this essay was that the court expected women to behave as the ideal victim, both after the assault and in conjunction with the requirements the court imposed on the woman's testimony. The woman's no-saying is of great importance in that she has the burden of proof. The analysis has focused on the problem that not all women react the same way after having been the subject to rape. Focus has also been on the problems surrounding the courts questioning of the woman's testimony and no-saying where the sexual responsibility once again is placed on the woman. (Less)
