Även om matchfixning och uppgjorda matcher har blivit ett allt mer omdiskuterat ämne det senaste åren saknas det i stort sett kunskap om hur läget är i Sverige. Det finns några enstaka forskningsrapporter och två hovrättsavgörande.

Avsikten med uppsatsen har varit att undersöka vilka legala möjligheter det finns idag för att beivra matchfixning och hur den föreslagna spelfuskbestämmelsen i SOU 2017:30 kan påverka lagföringsmöjligheterna samt om bestämmelsen kan tänkas få avsedd effekt.

För att utröna om den spelfuskbestämmelsen kan tänkas få effekt har jag använt kriminaliseringsprinciperna som analysinstrument.

I uppsatsen har jag refererat de hovrättsavgörande som finns avseende matchfixning och redogjort för vilka typer av matchfixning som finns och dess aktörer samt de vanligaste definitionerna av matchfixning.

I analysen kommer jag fram till att spelfuskbestämmelsen får svårt att uppfylla sitt syfte. Dessutom är formuleringen av utredningsförslaget så brett att det riskerar att omfatta fler situationer av matchfixning än avsett. Avsikten är att bestämmelsen endast ska omfatta matchfixning som omfattas av vadhållning och inte sportsligt motiverad matchfixning.

Bestämmelsen mest verkar ha avsikten att skydda förtroendet för den kommersiella spelmarknaden och i förlängningen skydda skatteintäkterna som genereras via spelmarknaden. (Less)

Even if match fixing and manipulated matches have been a widely discussed topic the last few years, we still lack any deeper knowledge about the situation in Sweden apart from a few research reports and two rulings from the Court of Appeal.

My intention with this bachelor thesis have been to examine which possibilities we have today to prosecute match fixing and how the proposed offence of cheating at gambling introduced in SOU 2017:30 can come to effect the possibilities to prosecute and if the regulation could have the intended effect.

In my effort in trying to determine if the proposed regulation could accomplish the desired effect I have used the common principles of criminalisation as an analytic tool.

Even if match fixing and manipulated matches have been a widely discussed topic the last few years, we still lack any deeper knowledge about the situation in Sweden apart from a few research reports and two rulings from the Court of Appeal.

My intention with this bachelor thesis have been to examine which possibilities we have today to prosecute match fixing and how the proposed offence of cheating at gambling introduced in SOU 2017:30 can come to effect the possibilities to prosecute and if the regulation could have the intended effect.

In my effort in trying to determine if the proposed regulation could accomplish the desired effect I have used the common principles of criminalisation as an analytic tool.

I have presented the rulings from the Court of Appeal regarding match fixing and I have also given a brief description of the different types of match fixing situations and of those who participate in this type of activity. I have also presented the most common definitions of match fixing.

In the analyze I come to the conclusion that the offence of cheating at gambling most likely won’t have much of an impact. The regulation also mostly seems to be aimed at preserving the trust for the commercial gambling market and as a consequence a protection of the tax income generated by the gambling market. Furthermore the wording of the proposed regulation are so wide in its definition that there seems to be a substantial risk that the regulation could cover more cases of match fixing than intended. The intention with the regulation are that only betting related match fixing should be included and not sports motivated match fixing. (Less)
