- Vi lever idag i ett samhälle som ständigt förändras med bland annat stora tekniska utvecklingar. Detta innebär även att brottsligheten förändras och skiftar med tiden. De svenska processrättsliga principerna är från 1940-talet och har en väldigt stor påverkan på förfarandet i brottmålsprocessen. Med utgångspunkt i omedelbarhetsprincipen och muntlighetsprincipen ska de bevis som man ämnar använda åberopas under huvudförhandlingen och det är enbart detta som domarna ska ta hänsyn till.
Denna uppsats syftar till att undersöka hur ett polisförhör får åberopas och användas under huvudförhandlingen. Utifrån ett rättssäkerhetsperspektiv ska jag analysera om gällande rätt är tillfredsställande eller om processen är föråldrad sett till dagens... Denna uppsats syftar till att undersöka hur ett polisförhör får åberopas och användas under huvudförhandlingen. Utifrån ett rättssäkerhetsperspektiv ska jag analysera om gällande rätt är tillfredsställande eller om processen är föråldrad sett till dagens samhälle. Antalet komplicerade brott ökar och detta i sig innebär att förundersökningen tar längre tid, antalet förhandlingstimmar under huvudförhandling stiger och väntetiderna på domstolarna ökar.
Själva brottmålsprocessen inleds med en förundersökning som ofta drivs av en åklagare, speciellt i mer komplicerade fall. Under denna process har åklagaren som mål att utreda om det finns grunder att väcka åtal mot en misstänkt, vilket bland annat uppnås genom polisförhör. Detta förhör har inte samma rättssäkerhetsgarantier som förhöret vid en huvudförhandling. Således är användningen av polisförhöret som bevis under huvudförhandlingen väldigt begränsad. Att parterna, muntligt och omedelbart, under huvudförhandlingen ska tillföra de bevisfaktum som de önskar leder däremot till att huvudförhandlingar blir tidskrävande och omfattande. De processrättsliga principerna har effektivitets- och processekonomiska skäl och ur ett rättssäkerhetsperspektiv kan man diskutera om detta är de bästa alternativen. Således är det möjligt att dessa processer är i behov av en revision. (Less) - Abstract
- We live in an ever changing society with major developments, especially in the technical field. This also means that the crimes committed today are different and more complex than before. The Swedish procedural principles are from the 1940s and they have an important influence on today’s criminal trial procedure. Based on the principle of oral procedure and the principle of immediateness the evidence that a party wishes to invoke must be done at the main hearing and it is only this that the judges will regard in their judgement.
This thesis aims to examine how a police interrogation can be invoked and used during the main hearing. With regards to this, I will analyse whether this system is satisfactory in regards to the perspective of... The Swedish procedural principles are from the 1940s and they have an important influence on today’s criminal trial procedure. Based on the principle of oral procedure and the principle of immediateness the evidence that a party wishes to invoke must be done at the main hearing and it is only this that the judges will regard in their judgement.
This thesis aims to examine how a police interrogation can be invoked and used during the main hearing. With regards to this, I will analyse whether this system is satisfactory in regards to the perspective of rule of law or if the process is obsolete in regards to today’s society. The complexity of crimes is increasing and the effect of this is that the preliminary investigation often takes longer and the negotiation hours during the main hearing increases.
The criminal procedure begins with a preliminary investigation which is often run by a prosecutor in more complex cases. During this process, the prosecutor aims to investigate whether there are grounds to prosecute the suspect. This is achieved by investigations, for example through police interrogations. These interrogations do not have the same procedural safeguards as a questioning during the main hearing in court. Thus, the use of police interrogations as evidence during the main hearing is very limited. On the other hand, the fact that the parties, verbally and immediately, during the main hearing must invoke their evidence has the consequence that the main hearing becomes more time-consuming and comprehensive. The procedural principles have efficiency and process economy reasons and from a perspective of rule of law, one can discuss whether these are the best alternatives. Thus, it is possible that these processes are in need of a review. (Less)
