- Abstract
- This essay concerns the legislation and legal procedures concerning the crime “rape”. We focus on rapes committed by young offenders and where young victims (girls) are involved. Media often presents a picture that raped girls don’t get a fair trial because she comes out as a bad looking girl in court. Our purpose has been to investigate and analyse rape from a historical and legal perspective and what problems that is connected to the crime. - This essay concerns the legislation and legal procedures concerning the crime “rape”. We focus on rapes committed by young offenders and where young victims (girls) are involved. Media often presents a picture that raped girls don’t get a fair trial because she comes out as a bad looking girl in court. Our purpose has been to investigate and analyse rape from a historical and legal perspective and what problems that is connected to the crime. Our main questions are: · How has rape as a crime been discussed and legally regulated in a historical context and what problems concerning the crime and law are debated today? · How are victims and offenders psychological and physical character described in the legal process? Fore example clothing, currant sexual behaviour, relationships and rumour. · What consequences does this descriptions have in the legal process and final judgement? We chose to make an analysis of document with six judgements from courts. As a compliment to this study we have made three interviews with judges, lawyers and one interview with a woman who works with woman who are victims of rape. We have used our interviews, the judgements and earlier research to answer our questions. Our conclusions are that according to our judgements analysis, litterature and interviews both the victims and the offenders’ character are discussed in court. (Less)
