Abstract
According to Lundquist, professor in political science at Lund University, there are six different kinds of steering that rule the activities of the authority. The different kinds of steering can be divided into two different groups&semic direct and indirect steering. Steering by order means that the superior rules how the public authority perform their duty in individual matters. Steering by rules means that the steering is performed by general rules. According to Lundquist, professor in political science at Lund University, there are six different kinds of steering that rule the activities of the authority. The different kinds of steering can be divided into two different groups&semic direct and indirect steering. Steering by order means that the superior rules how the public authority perform their duty in individual matters. Steering by rules means that the steering is performed by general rules. Here, the most important techniques by steering are the laws of the parliament and the regulations by the government. Steering by rules includes steering by goals. By steering by Government subsidies the government can benefit certain spheres and allot the authority Government subsidy who it needs for the implementation of the direct steering. Steering by recruit means that the Government appoint a certain person to a post or that it states which requirements there will be on persons who will be employed at a public post. Steering by organisation is about the structure of the authority with the establishment of roles and determine of localisation. By steering by information the Government steers which information a subordinate gets, this to influence the subordinates decisions or assessments. Drug test of youth under 15 years old has in this paper specially been chosen as a part of steering by rules. Drug test is a constraint that is regulated in chapter 28 of the Trial Code. It follows by chapter 28, 12 § that you can make a body investigation of a person who can be reasonably suspected for a crime which for prison can follow. In accordance with chapter 1, 6§ of the Penal Code, offenders under 15 years of age have no criminal responsibility. In 36 § of the Law of juvenile delinquency enumerates the constraint who can be carried out against a youth under 15 years old that is suspected for having committed a crime. E contrario one can understand that a body investigation is not allowed to do. The Swedish Government recommended an amendment and in October 2007 they suggested a directive where a review will be performed regarding the regulations in the Law of juvenile delinquency that concern drug tests of youth under 15. UNG (the youth- and drug group) works in the area of Öresund and works mainly with youth that commit drug crimes. To find out how the steering of the authority is understood by the people who works at this public authority, interviews have been held with four police officers at UNG. They comment on the kind of steering by goals which mean that a certain number of crimes of a certain kind must be reported during one year. About this kind of steering, the opinions are divided. Some of the steering that is indirect, for example steering by Government subsidy and steering by recruit, is mostly handled by directors at a higher level. There were also opinions about steering by rules, for example about the restrictions at the official secrets legislation at the information transference and deficient knowledge about the meaning of the Official Secrets Legislation. The police officers considered that an amendment ought to be done to enable that a drug test can be done with force at youth less than 15 years old. UNG works to prevent that youth will test drugs and then start to abuse drugs. The police need, for that reason, to be able to intervene as early as possible to prevent this. (Less)
