- Abstract
- This study investigates the claim that German juvenile criminal law often fails to adequately address the ''educational focus'' intended by the authors of the Youth Court Act (Jugendgerichtsgesetz) [hypothesis 1]. Further, the study examines a second claim, that this neglect stems from the inadequate design of the Youth Court Act and a lack of resources to carry it out in practice (e.g. insufficient financial means) [hypothesis 2]. - This study investigates the claim that German juvenile criminal law often fails to adequately address the ''educational focus'' intended by the authors of the Youth Court Act (Jugendgerichtsgesetz) [hypothesis 1]. Further, the study examines a second claim, that this neglect stems from the inadequate design of the Youth Court Act and a lack of resources to carry it out in practice (e.g. insufficient financial means) [hypothesis 2]. The research was primarily compiled through interviews with 12 people working in the field of youth justice (lawyers, prosecutors, judges and ''social workers'' connected to the Youth Court). Of importance was the observation of the cooperation - or lack of it - between these different institutions - and its influence on judicial practice in this area. The study clearly confirmed hypothesis 1. Hypothesis 2 was partially rejected, since the design of the Youth Court Act was found to be adequate, even if the means to carry it out in practice are limited. The cooperation between the institutions was found to work poorly&semic it is therefore important to increase the mutual understanding between the different professions. Finally, this study also aims to create an extended platform for the discussion about the treatment of young offenders in Sweden - and to present a possible alternative to the Swedish juvenile criminal system.
