Grön upphandling: FN, WTO och EU

Abstract
Sustainable or green procurement has grown as one policy instrument among others to affect the environment in a positive way. Sustainable procurement is a complex instrument - many interests must be balanced in order for it to be effective in an economic way. This essay describes what happens when this policy instrument meets the legal and political environment of the WTO, the EU and the UN.
The first part of the essay discusses procurement changes as such. What are the incentives and obstacles to procurement change and what are economically most effective? Sustainable or green procurement has grown as one policy instrument among others to affect the environment in a positive way. Sustainable procurement is a complex instrument - many interests must be balanced in order for it to be effective in an economic way. This essay describes what happens when this policy instrument meets the legal and political environment of the WTO, the EU and the UN.
The first part of the essay discusses procurement changes as such. What are the incentives and obstacles to procurement change and what are economically most effective? Procurement reform is put in relation to the international regulations of public procurement. Public procurement is regulated by the Word Trade Organization and these regulations are becoming increasingly important. After that the European Union’s procurement regulation is described.
Next part of the essay discusses UN procurements. The extent and regulation of UN procurements is described. A majority of the member nations oppose changes in procurement for economic reasons. The suggested changes would benefit member nations with a highly developed industry and thus, countries with a less developed industry are opposed to the changes. Nonetheless, changes in UN procurement are taking place. The organization is preparing to quickly change its procurement. Guidelines are being developed and staff is being trained into the concept. But the actual procurement is also changing. Step by step UN procurement is being done in a more sustainable way. This change is occurring without any rule changes. It is an intra-organization driven change in practice without any changes in regulation.
In the last part of the essay the development of international procurement regulation is discussed and analyzed. My conclusion is that a global effective procurement regulation is not to be expected in the near future but regions may integrate their procurements to make their economies more effective. (Less)

Upphandling är ett komplicerat styrmedel där många intressen måste balanseras för att ekonomisk effektiv ska kunna uppnås. Uppsatsen beskriver vad som händer när detta instrument möter regelverken och den politiska miljön i WTO, EU och FN.

Uppsatsens inledande del behandlar upphandlingsförändring. Vilka incitament och hinder föreligger och vilka är de ekonomiskt effektiva lösningarna? Efter det beskrivs den internationella reglering som finns kring offentlig upphandling. 40 av WTO:s medlemmar har anslutit sig till ”The Agreement on Government Procurement” vars syfte är att öppna upp offentlig upphandling för internationell konkurrens. Inom EU regleras den offentliga upphandlingen både genom unionens gemensamma principer och genom särskilda upphandlingsdirektiv. Innebörden av dessa regelsystem och dess genomslagskraft beskrivs.

Efter det beskrivs FN:s upphandling. En majoritet av FN:s medlemsstater är motståndare till hållbar upphandling och anledningarna till detta är ekonomiska. De länder som tjänar på hållbar upphandling är för en förändring och de som förlorar är motståndare. Trots det motstånd mot hållbar upphandling som finns bland en majoritet av FN:s medlemmar håller FN:s upphandling på att förändras. Detta arbete sker på två sätt: organisationen förbereds för att snabbt kunna implementera hållbara upphandlingskriterier och tillämpningen av rådande regelverk förskjuts försiktigt i hållbar riktning. Inom FN håller det på att ske en organisationsdriven förändringsprocess av tillämpning utan egentligt stöd i ett förändrat regelverk.

I uppsatsens avslutande del diskuteras de olika regelsystemens förhållande till varandra. Min slutsats är att ett internationellt kraftfullt regelverk kring offentlig upphandling lär dröja men att regioner kan komma att integrera deras upphandling för att uppnå ekonomisk effektivitet (Less)
