Abstract
How to define Private Military Companies is an issue, which due to PMC’s explosive growth during the last 30 years has become increasingly relevant. But how do you define the PMC personnel that take a direct part in combat situations?

Through a singularly juridical aspect, based on interpretations of the Geneva Conventions I try to answer this problem.

This essay first tries to define the PMC first gives an historical introduction which show how the concept of Mercenaries changes throughout the course of history, and how the East Indian Companies are considered to be the first models of modern PMC’s.

How to define Private Military Companies is an issue, which due to PMC’s explosive growth during the last 30 years has become increasingly relevant. But how do you define the PMC personnel that take a direct part in combat situations?

Through a singularly juridical aspect, based on interpretations of the Geneva Conventions I try to answer this problem.

This essay first tries to define the PMC first gives an historical introduction which show how the concept of Mercenaries changes throughout the course of history, and how the East Indian Companies are considered to be the first models of modern PMC’s.

In the history section a short explanation is also given to the founding of the International Committee of the Red Cross and the forming of the Geneva conventions as those are considered the founding documents on modern International Humanitarian Law.

Generally defining PMC’s with existing IHL and International law documents showed to be impossible and therefore, it was necessary to narrow the scope by defining PMC’s personnel in a specific situation from a few selected parameters.

However as some parameters where fulfilled and other were not a discussion on how to proceed was necessary. The Concluding disucssion showed that further research in the field in necessary and perhaps new international organs must be created to control PMC’s in the future. (Less)
