Ersättningar vid immaterialrättsliga intrång i svensk och japansk rätt – särskilt om ersättning vid patentintrång

Denna uppsats är en komparativ analys av hur ersättningar vid immaterialrättsliga intrång beräknas i svensk respektive japansk rätt. Tyngdpunkten ligger på hur beräkningen görs vid patentintrång. Uppsatsen är indelad i sex kapitel, varav det första består av en inledning.
I det andra kapitlet belyses den generella uppbyggnaden av och vilka principer som ligger till grund för ersättningsreglerna på immaterialrättens område med utgångspunkt i svensk rätt. Detta inkluderar hur allmänna skadeståndsrättsliga principer tillämpas vid intrång i immateriella rättigheter.
Det tredje och fjärde kapitlet behandlar hur lagstiftaren i respektive land valt att formulera ersättningsreglerna och vilka lagstiftningstekniska lösningar de valt. Då... (More)

I det andra kapitlet belyses den generella uppbyggnaden av och vilka principer som ligger till grund för ersättningsreglerna på immaterialrättens område med utgångspunkt i svensk rätt. Detta inkluderar hur allmänna skadeståndsrättsliga principer tillämpas vid intrång i immateriella rättigheter.
Det tredje och fjärde kapitlet behandlar hur lagstiftaren i respektive land valt att formulera ersättningsreglerna och vilka lagstiftningstekniska lösningar de valt. Då regelsystemen i båda länderna genomgått förändringar i relativt modern tid (Sverige 2009 och Japan 1998), belyses de nya lydelserna i relation till hur de var formulerade tidigare.
I det femte kapitlet läggs fokus på ersättningsbestämmelserna vid patentintrång och framförallt hur domstolspraxis på området ser ut i respektive land.
I det sjätte och sista kapitlet görs en komparativ analys av respektive lagstiftnings angreppssätt. Detta sker med utgångspunkt i ett hypotetiskt fall av patentintrång, varpå reglerna tillämpas och slutsatser dras utifrån de olika resultaten. This thesis is a comparative study of Swedish and Japanese law as to how damages for infringement of intellectual property rights, with emphasis on patent rights, are calculated in general and in practice. The thesis is divided into six chapters, the first being an introduction.
The second chapter examines the general principles relevant for the estimation of damages arising from an intellectual property infringement. Therein the general framework of the Swedish regulations and the reasoning behind them is explained. This includes how basic tort principles in Swedish law apply in a case of intellectual property infringement.

This thesis is a comparative study of Swedish and Japanese law as to how damages for infringement of intellectual property rights, with emphasis on patent rights, are calculated in general and in practice. The thesis is divided into six chapters, the first being an introduction.
The second chapter examines the general principles relevant for the estimation of damages arising from an intellectual property infringement. Therein the general framework of the Swedish regulations and the reasoning behind them is explained. This includes how basic tort principles in Swedish law apply in a case of intellectual property infringement.
The third and fourth chapter examines the Swedish and Japanese rules for estimating damages arising from intellectual property infringements as they are expressed in their respective laws. Since both countries have made amendments to their laws in this area in fairly recent times (Japan in 1998 and Sweden in 2009) the chapter includes a brief look at the laws in their older form as well as after the respective amendments.
The fifth chapter focuses specifically on the estimation of damages in the case of a patent infringement, comparing the Swedish and Japanese rules, including extensive references to relevant case law.
The sixth and final chapter examines the differences and similarities of Swedish and Japanese law using a hypothetical case of patent infringement. The different rules are applied to the same facts and the result is used as a basis for comparison of the Swedish and Japanese rules. The author’s own comments are predominantly found here. (Less)
