Umgänge mellan barn och föräldrar - i överensstämmelse med barnets bästa och vilja?

En grundläggande utgångspunkt enligt svensk lag, är att barn har rätt till umgänge med den förälder som barnet inte bor tillsammans med – men hur värnas denna rätt?

Barn är omyndiga och har ingen legal möjlighet att väcka talan vid domstol i dessa ärenden. Enligt domstolsverket avgjordes dock cirka 3000 fall år 2009 avseende vårdnad, boende och umgänge vid domstolarna i landet. Närmare en halv miljon barn i Sverige bor inte med båda sina föräldrar, enligt Barnombudsmannen.

Enligt domstolsverket avgjordes dock cirka 3000 fall år 2009 avseende vårdnad, boende och umgänge vid domstolarna i landet. Närmare en halv miljon barn i Sverige bor inte med båda sina föräldrar, enligt Barnombudsmannen.

Uppsatsen behandlar den lagstadgade umgängesrätt som barnet har i dessa fall och tar sin utgångspunkt i gällande rätt på området. En särskild redogörelse ägnas det så kallade barnperspektivet, samt begreppen barnets bästa och barnets vilja. Även vissa internationella bestämmelser i Förenta Nationernas konvention om barnets rättigheter och den europeiska konventionen angående skydd för de mänskliga rättigheterna och de grundläggande friheterna berörs.

Enligt doktrin presenteras olika synsätt avseende tolkning av gällande rätt och hur synen på barnet har förändrats i rättsprocessen. Till detta fogas även en intervju med en på området verksam domare.

I analysen framkommer att begreppen barnets bästa och barnets vilja i den juridiska debatten är föremål för omfattande diskussion. Inte minst hänvisar många till en, som man menar, bristfällig prövning i det enskilda fallet.

I en avslutande reflektion betonas vikten av psykologisk fackkunskap i sammanhanget. (Less)

Childrens right of access to the parent with whom they don’t reside is a fundmental point of view according to Swedish law – but how is this right maintained?

Children are regarded as minors and they have no means to institute legal proceedings before the court, in these matters. However, according to the national courts administration, around 3000 cases regarding custody, residence and access were settled in 2009 before the courts throughout the country. Closer to half a million children in Sweden don’t live with both of their parents, according to the Ombudsman for Children.

Childrens right of access to the parent with whom they don’t reside is a fundmental point of view according to Swedish law – but how is this right maintained?

Children are regarded as minors and they have no means to institute legal proceedings before the court, in these matters. However, according to the national courts administration, around 3000 cases regarding custody, residence and access were settled in 2009 before the courts throughout the country. Closer to half a million children in Sweden don’t live with both of their parents, according to the Ombudsman for Children.

This essay deals with the matter of children’s statutory right of access and takes its starting point in established law of the area. A specific account is assigned to the so called “childrens perspective”, along with the concepts the “best interest of the child” and the “will of the child”. Some regulations of international nature as the United Nations Convention on the Rights of the Child and the Convention for the Protection of Human Rights and Fundamental Freedoms are also addressed.

Different points of view regarding interpretation of the established law and how the view of the child has changed within the judicial process are presented according to doctrine. In addition to this, an interview with an active judge within this area is enclosed.

The analysis reveales different points of view, which are subject to extensive discussions in the judicial debate, regarding interpretation of the concepts the “best interest of the child” and the “will of the child”. None the less many refer to an, which they mean, inadequate examination in the specific case.

In a closing reflection, the weight of professional psychological knowledge within the context is emphasized. (Less)
