Bullying, harassments and other forms of emotional abuse at the workplace are matters which lately have garnered a lot of publicity. A series of articles in Dagens Nyheter in the summer of 2010 left many readers wondering about the legal situation for those exposed to emotional abuse and the responsibilities employers and employees have in regard to problems in the psychosocial work environment. As a result of this, the purpose of this essay has been to present current right regarding emotional abuse. Using legal scientific method, Swedish law regarding work environment matters and questions of emotional abuse in particular, have been described and analyzed. Bullying, harassments and other forms of emotional abuse at the workplace are matters which lately have garnered a lot of publicity. A series of articles in Dagens Nyheter in the summer of 2010 left many readers wondering about the legal situation for those exposed to emotional abuse and the responsibilities employers and employees have in regard to problems in the psychosocial work environment. As a result of this, the purpose of this essay has been to present current right regarding emotional abuse. Using legal scientific method, Swedish law regarding work environment matters and questions of emotional abuse in particular, have been described and analyzed. The conclusion of the essay is that while there are both good intentions as well as a certain legal security for the person who is emotionally abused, there are also evident flaws. Persons who are bullied face a less secure position than persons who are discriminated, who at least are in power to demand compensation in the form of paid damages. The circumstances are such, that there would be a merit in re-evaluating what society, the work market in particular, would have to gain and lose in making bullying and other forms of emotional abuse a criminal offense.
