- Abstract
- This is a qualitative, descriptive discourse analysis of the decisionmaking process preceding the regulation of a national immunisation record. Presently, no law in Sweden regulates such a record. The study aims to examine if a regulation is needed, what kind of regulation is needed and who should decide about the implementation of such a regulation. Niklas Luhmann’s theory of decision-making within organizations and Michel Foucault’s discourse concept are central in the study. Through discourse analysis the study examines the interests that are domi-nant in the process leading to a decision. - This is a qualitative, descriptive discourse analysis of the decisionmaking process preceding the regulation of a national immunisation record. Presently, no law in Sweden regulates such a record. The study aims to examine if a regulation is needed, what kind of regulation is needed and who should decide about the implementation of such a regulation. Niklas Luhmann’s theory of decision-making within organizations and Michel Foucault’s discourse concept are central in the study. Through discourse analysis the study examines the interests that are domi-nant in the process leading to a decision. The study analyzes statements in six documents published by authorities, interest organizations and law experts. Focus is directed towards certain signs of values that stand out in the statements, such as “personal integrity”, “secrecy”, “solidarity” and “eHealth”. The dominant discourses appearing among the authorities and interest organizations express an ambition to increase the disciplining of citizens. The law experts, on the other hand, emphasize the importance of the individual’s personal integrity. The conclusion of the study is that a regulation is needed and a special law designed for the specific purpose should be made. However, such a law presupposes a political decision or concerned organizations are risking ceasing to function. (Less)

Studiedesign: Kvalitativ, deskriptiv diskursanalys av sex dokument publicerade av aktörer med intressen i beslutsprocessen.

Teori: Studien tar sin ansats i Niklas Luhmanns systemteori om hur organisationer riskerar att sluta fungera då en tydlig beslutsfattare – en s.k. skiljedomare – inte är utsedd. Centralt i studien är också Michel Foucaults diskursbegrepp som handlar om hur olika intressesfärer utövar makt genom att inkludera eller exkludera särskilda utsagor i sina beskrivningar av verkligheten.
Metod och material: Genom dokumentanalys så analyseras sex olika utsagor utgivna av Socialdepartementet, Socialstyrelsen, Vetenskapsrådet, Sveriges Kommuner och Landsting, Smittskyddsinstitutet samt två juridiska experter. I analysen av utsagorna så identifieras framträdande diskurser som påverkar beslutsprocessen.
Resultat: I analysen framträder diskurser som förespråkar en stark disciplinering av medbogarna, t.ex. genom ett vaccinationsregister. Huruvida man anser att detta bör ske genom centraliserade eller decentraliserade åtgärder varierar. De juridiska experterna skiljer sig från övriga utsagor då en etisk diskurs där den personliga integriteten väger mycket tungt istället är framträdande.
Slutsatser: Analysen tyder på att ett nationellt vaccinationsregister förmodligen kommer att införas. En reglering är därför nödvändig. Den bästa lösningen vore en speciallag som i detalj beskriver vem som får föra ett nationellt register, vilka uppgifter som får lagras i registret och vad uppgifterna får användas till. Ett beslut om detta måste komma från politiskt håll. Så länge ett politiskt beslut saknas så opererar berörda organisationer i ovisshet och riskerar att sluta fungera. (Less)
