Miljöorganisationers talerätt har debatterats livligt alltsedan miljöbalkens tillkomst, då möjligheten för miljöorganisationer att erkännas talerätt introducerades. Starka röster, så som näringslivet och verksamhetsutövare är kritiska och menar att en utökad talerätt för miljöorganisationer kommer leda till försenade och fördyrade projekt, då antalet överklaganden skulle öka drastiskt och på så sätt också motverka en effektiv behandling av ärendena.

Förespråkarna däremot, menar att denna oro är obefogad och hänvisar till ett flertal utredningar som påvisar att en utökad talerätt istället leder till en större åtlydnad av miljöreglerna. Vidare menar de att antalet överklaganden av myndigheters eller domstolars beslut inte har ökat i de... (More)
Miljöorganisationers talerätt har debatterats livligt alltsedan miljöbalkens tillkomst, då möjligheten för miljöorganisationer att erkännas talerätt introducerades. Starka röster, så som näringslivet och verksamhetsutövare är kritiska och menar att en utökad talerätt för miljöorganisationer kommer leda till försenade och fördyrade projekt, då antalet överklaganden skulle öka drastiskt och på så sätt också motverka en effektiv behandling av ärendena.

Förespråkarna däremot, menar att denna oro är obefogad och hänvisar till ett flertal utredningar som påvisar att en utökad talerätt istället leder till en större åtlydnad av miljöreglerna. Vidare menar de att antalet överklaganden av myndigheters eller domstolars beslut inte har ökat i de länder där miljöorganisationer erkänns en vidsträckt talerätt, utan snarare lett till en effektivare och mer samlad prövning av de olika överklagandena.

Denna uppsats behandlar således miljöorganisationers talerätt vad gäller allmänna intressen. Vidare diskuteras hur kvalificeringsreglerna i 16:13 MB förhåller sig till Århuskonventionen och EU-rätten. I uppsatsen klargörs vad såväl nationell- som internationell rätt stipulerar om miljöorganisationers talerätt, men de svenska reglerna diskuteras utifrån ett internationellt perspektiv. Slutsatsen är att Sveriges reglering till vissa delar strider mot Åhuskonventionen och EU-rätten, då kravet på medlemsantal och verksamhetstid i Sverige medför att endast ett fåtal miljöorganisationer erkänns talerätt enligt 16:13 MB. Inte heller kan miljöorganisationer inleda domstols- och förvaltningsförfaranden i miljöfrågor enligt svensk rätt. Vidare är antalet domar och beslut som kan överklagas av miljöorganisationer för få, sett till Århuskonventionen EU-rätten. (Less)
Abstract
The right of action of environmental organisations have been lively debated ever since the establishment of miljöbalken, when the possibility of allowing environmental organisations right of action first was acknowledged. Strong voices, such as those of the industry and enterprises are critical and mean that an extended right of action for environmental organisations will lead to project delays and higher costs, as the number of appeals would increase drastically, hence obstructing an efficient consideration of the project leading up to higher costs for the investigations

The right of action of environmental organisations have been lively debated ever since the establishment of miljöbalken, when the possibility of allowing environmental organisations right of action first was acknowledged. Strong voices, such as those of the industry and enterprises are critical and mean that an extended right of action for environmental organisations will lead to project delays and higher costs, as the number of appeals would increase drastically, hence obstructing an efficient consideration of the project leading up to higher costs for the investigations
as well.

Those in favour on the other hand mean that this concern is unjustified and point at a number of investigations demonstrating that an extended right of action rather lead to an increased level of observance to the environmental laws. Furthermore, they point at the fact that the number of appeals against controlling authorities’ or courts’ rulings have not increased in countries where a wider right of action for environmental organisations have been established, but that it has rather lead to a more efficient and collected examination of the different appeals.

This essay is an analysis of the right of action of environmental organisations and what effect it has on public interests. Furthermore, a discussion on what line the rules of qualification, presented in 16:13 MB, take towards the Aarhus convention and the EU-law. It is demonstrated, in the essay, what national- and international law stipulates regarding the right of action of environmental organisations, but the Swedish rules are put in an international perspective. The conclusion is that the rules and regulation of Sweden in part contravents to those established in the Aarhus convention and the EU-law, as the demand of high membership numbers and required number of years of establishment result in the fact that only a mere few environmental organisations are granted right of action according to 16:13 MB. In addition, according to Swedish law, environmental organisations cannot initiate an appeal to an administrative authority in environmental questions according to Swedish law. (Less)
