Föroreningar på en fastighet berör fastighetsägaren på olika sätt. En direkt effekt av föroreningarna kan vara att fastighetsägarens möjligheter att använda marken begränsas och att värdet på fastigheten påverkas. Det kan också få till följd att fastigheten blir svår att avyttra. Framförallt kan en förorening på fastigheten innebära att fastighetsägaren riskerar miljörättsliga krav på att vidta avhjälpandeåtgärder mot föroreningsskadan. Det kan också få till följd att fastigheten blir svår att avyttra. Framförallt kan en förorening på fastigheten innebära att fastighetsägaren riskerar miljörättsliga krav på att vidta avhjälpandeåtgärder mot föroreningsskadan. Huvudregeln enligt svensk miljörätt är att den som bedriver eller har bedrivit en verksamhet, eller vidtagit en åtgärd som har bidragit till att en föroreningsskada uppstått på en fastighet bär det primära ansvaret för att vidta åtgärder för att avhjälpa föroreningsskadan. Regeln ger uttryck för den internationellt erkända principen om att förorenaren betalar, ”pollutor pays principle”. Om det inte finns någon verksamhetsutövare som kan utföra eller bekosta avhjälpandet flyttas ansvaret till fastighetsägaren eller tidigare fastighetsägare, förutsatt att denne vid förvärvet känt till eller borde känna till föroreningen samt att fastigheten förvärvades efter 1 januari år 1999. Det innebär att fastighetsägare som inte själva förorenat fastigheten ändå kan tvingas avhjälpa föroreningsskador. Syftet med det subsidiära ansvaret för fastighetsägare är att få till stånd markundersökningar före förvärv av näringsfastigheter för att på så sätt få marknadens aktörer att bidra till en bättre miljö. Avhjälpandeprojekt kan både vara kostnadskrävande och komplicerade, inte minst för en mindre aktör. Ett förvärv av en fastighet som har en föroreningsskada kan således bli en betydligt mer kostsam affär än vad som från början var tänkt. Utgångspunkten för fastighetsförvärv enligt JB är att en fastighet säljs så som den är, och att det är upp till köparen att skydda sig genom att göra en undersökning av fastigheten innan förvärvet. Det förekommer dock situationer där köparen har rätt att åberopa att fastigheten är behäftad med fel. En föroreningsskada bör i vissa fall kunna anses utgöra ett faktiskt fel, vilket berättigar köparen att göra vissa påföljder gällande, exempelvis prisavdrag. Vanligtvis friskriver säljaren sig dock från sådana fel varpå köparen förlorar sin rätt att göra felpåföljder gällande. Reglerna i JB kan heller inte påverka fastighetsförvärvarens miljörättsliga ansvar gentemot det allmänna som föreskrivs i MB. Miljöansvaret har blivit en allt viktigare riskfråga i överlåtelseavtal rörande fastigheter. Säljaren vill lägga risken för att åläggas avhjälpandeansvar bakom sig medan köparen inte vill köpa på sig ett eventuellt avhjälpandeansvar. Bestämmelserna om avhjälpandeansvar för föroreningsskador är offentligrättsliga och indispositiva regler. Det ansvarssubjekt som tillsynsmyndigheten väljer att rikta föreläggande om avhjälpandeåtgärder mot, påverkas inte av ett civilrättsligt avtal mellan köparen och säljaren. Däremot kan parterna i avtal reglera hur kostnaden för ett sådant ansvar ska fördelas inbördes, i det fall ett avhjälpandeansvar skulle utkrävas. (Less)

Pollution of real estate affects the owner in different ways. As a direct effect, the possibilities of using the land may be limited, and the value of the real estate can be influenced. The real estate may also be difficult to sell. Above all, pollution of real estate may involve environmental legal demands on the owner to repair the damage. The main rule of the Swedish environmental code is that whoever runs, or has run, an activity, or contributed to a pollution, carries the primary responsibility to take action to repair the damage. The rule expresses the internationally accepted principle, that the polluter pays. If there is no operator at hand that can repair or pay for the repair of the damage, then the responsibility is transferred... (More)

The real estate may also be difficult to sell. Above all, pollution of real estate may involve environmental legal demands on the owner to repair the damage. The main rule of the Swedish environmental code is that whoever runs, or has run, an activity, or contributed to a pollution, carries the primary responsibility to take action to repair the damage. The rule expresses the internationally accepted principle, that the polluter pays. If there is no operator at hand that can repair or pay for the repair of the damage, then the responsibility is transferred to the owner or prior owners provided that one of these, at the time of acquisition, knew or should have known about the pollution. Additionally, the real estate should have been acquired after January 1st, 1999. This implies, that an owner, who has not polluted the real estate himself, can be forced to take responsibility for its condition. The purpose of the subsidiary responsibility of the owner is to bring about an examination of the ground prior to acquisition of industrial real estate, and in that way make the market actors contribute to a better environment. However, repairing can be both financially demanding and complicated, at least for a minor actor. The acquisition of polluted real estate can, in that way, be a substantially more expensive deal, than initially intended. According to the Swedish code of land law, the basis of acquisition of a property is, that it is sold in its present condition. It is the responsibility of the buyer to protect himself by conducting an examination prior to the acquisition. However, situations, in which the buyer is entitled to plead a damaged real estate, do occur. In certain cases, pollution damage should be regarded as an actual fault, which entitles the buyer to maintain certain sanctions, for instance a price reduction. Usually, the vendor disavows these faults on which the buyer loses his right to maintain sanctions. Neither can the rules of the code of land law affect the environmentally legal responsibility towards the general public, as prescribed in the environmental code. The environmental responsibility has become an increasingly important issue in transfer agreements concerning real estate. The vendor wants to escape a responsibility of repair while the buyer will avoid buying a problem. The regulations of responsibility of repair concerning pollution damages are public legal and the rules are indispositive. The subject of responsibility towards which the supervising authority chooses to direct injunction of repair, is not affected by a civil law agreement between the buyer and the vendor. On the other hand, the parties can agree on a mutual regulation of costs, if such a responsibility should be demanded. (Less)
