I denna uppsats berörs rätten till familjeåterförening. Denna rätt kan studeras ur olika perspektiv och olika synvinklar. I uppsatsen undersöks kretsen av familjemedlemmar som har rätt till familjeåterförening med särskild fokus på deras rätt att följa med eller ansluta sig till en unionsmedborgare och tredjelandsmedborgare bosatt i medlemsstaten. Det är således detta perspektiv som ligger i grunden för uppsatsens materiella frågeställningar. Därtill är det också en fråga om medlemsstaternas nationella självbestämmande i frågor som rör anhöriginvandring kontra EU-rättsliga supranationella inflyttande och strävan till harmonisering av medlemsstaternas lagstiftning på området.

I denna uppsats berörs rätten till familjeåterförening. Denna rätt kan studeras ur olika perspektiv och olika synvinklar. I uppsatsen undersöks kretsen av familjemedlemmar som har rätt till familjeåterförening med särskild fokus på deras rätt att följa med eller ansluta sig till en unionsmedborgare och tredjelandsmedborgare bosatt i medlemsstaten. Det är således detta perspektiv som ligger i grunden för uppsatsens materiella frågeställningar. Därtill är det också en fråga om medlemsstaternas nationella självbestämmande i frågor som rör anhöriginvandring kontra EU-rättsliga supranationella inflyttande och strävan till harmonisering av medlemsstaternas lagstiftning på området.

För att få svar på uppsatsens EU-rättsliga materiella frågeställningar har EU-domstolens praxis utgjort ett viktigt analysmaterial tillsammans med rörlighets- och familjeåterföreningsdirektivets relevanta bestämmelser, kommissionens rapporter samt doktrin. Vad gäller regleringen av anhöriginvandringen i den svenska lagstiftningen utgick jag ifrån utlänningslagens bestämmelser, förarbeten och återigen doktrin.

I uppsatsen har jag kommit fram till att rörlighetsdirektivets familjebegrepp är något vidare än familjeåterföreningsdirektivets och omfattar även samkönade äktenskap under förutsättningen att den mottagande medlemsstatens lagstiftning behandlar registrerade partnerskap som likvärdiga med äktenskap. Båda direktiven innehåller såväl obligatoriska som fakultativa bestämmelser vilket gör att de medlemsstater vars lagstiftning föreskriver ett snävt familjebegrepp har stort handlingsutrymme för att begränsa rätten till familjeåterförening vilket i sin tur avsevärt försvarar det supranationella inflyttande och lagharmoniseringen på unionsnivån. Abstract
This master thesis deals with the issues connected to the right to family reunification. This right can be studied from several different perspectives and different angles. The paper examines the circle of family members who may be entitled to family reunification with a particular focus on their right to accompany or join EU citizens and third country nationals residing in the State. Thus, it is this perspective that forms the basis of the essay. Additionally, it is a matter of national self-determination in matters relating to family reunification versus the EU’s supranational legal immigrant influence and efforts for harmonization of national legislation in the area.

This master thesis deals with the issues connected to the right to family reunification. This right can be studied from several different perspectives and different angles. The paper examines the circle of family members who may be entitled to family reunification with a particular focus on their right to accompany or join EU citizens and third country nationals residing in the State. Thus, it is this perspective that forms the basis of the essay. Additionally, it is a matter of national self-determination in matters relating to family reunification versus the EU’s supranational legal immigrant influence and efforts for harmonization of national legislation in the area.
To get some answers on the EU legal issues of substance, the case law of the EU Court of Justice constituted an important material for making analyses along with mobility and family reunification directive relevant provisions, the Commission reports and interpretive doctrine. As for the regulation of the family migration in the Swedish legislation, I analyzed the provisions of the Aliens Act's, legislative history and again explanatory doctrine.
In this essay, I have concluded that the family concept within the Movement Directive is somewhat broader than within the Family Reunification Directive and includes same-sex marriage under the assumption that the host Member State treats registered partnerships as equivalent to marriage. Both directives include both mandatory and optional provisions enabling the Member States whose legislation provides for a narrow concept of the family to have a broad discretion to limit the right to family reunification, which in turn significantly defends the supranational immigrant influence and law harmonization at the EU level.
