- Uppsatsen behandlar immaterialrätters uppkomst och transaktion inom en avgränsad del av öppen innovation, vilken går under namnet crowdcasting. Ämnet tycks relevant då vi i vår vardag möts av ett ökat krav på innovation inom våra företag och organisationer för att upprätthålla våra internationella konkurrensfördelar över tiden. Tillika sker överföringen från akademiska teorier till marknadsmässigt praktiserande allt snabbare, men hur regleras och fördelas då dessa uppkomna rättigheter?
Redogörelsen grundar sig främst på vetenskapliga teorier om öppen innovation och dess olika undergrenar, ett praktiskt fall där crowdcasting förekommer, därtill behandlas svensk immaterialrättslig lagstiftning för att försöka finna en lösning och dra... Redogörelsen grundar sig främst på vetenskapliga teorier om öppen innovation och dess olika undergrenar, ett praktiskt fall där crowdcasting förekommer, därtill behandlas svensk immaterialrättslig lagstiftning för att försöka finna en lösning och dra paralleller med andra existerande partsförhållanden.
Resultatet av detta är att författaren kan konstatera att det enligt svensk lag är den ursprungliga innovatören som blir skyddssubjekt och därtill erhåller upphovsrätten till det skapade verket, förutsatt att inget annat avtalats eller stipuleras enligt arbetsrättslig praxis. För att med framgång överföra åtminstone de ekonomiska rättigheterna, krävs det med vissa undantag ett väl specificerat avtal om var och hur rättigheterna överförs. Ett sådant svenskt avtal som är anpassat för just crowdcasting står ej att finna än så länge. Däremot kan många grundläggande formuleringar och tankar inlånas från andra sammanhang där upphovsrättsliga transaktioner sker. Inte heller open source-licenser är vidare anpassade för crowdcasting-sammanhang. Varpå det framöver kan behövas ett standardavtal inom området. (Less) - Abstract

The topic seems relevant when we in our everyday lives is met by an increased demand for innovation within our companies and organizations in order to maintain our international competitive advantage. It is also so that the transfer from academic theories to market usage is accelerating, but who are entitled to these rights?
The report is primarily based on scientific theories on open innovation and its various sub-branches, but even on a real case where crowdcasting occur, Swedish intellectual property laws are also analyzed in an attempt to find a solution.

In order to successfully transmit at least the economic rights, it requires, with certain exceptions a well-specified contracts where and how rights are transferred. Such Swedish agreements that are specific designed for just crowdcasting is not to be found so far.
However, many basic expressions and thoughts can be borrowed from other contexts where copyright transactions occur. Nor open source licenses are further customized for a crowdcasting context, whereupon the future may require a standard agreement in this field. (Less)
