Sammanfattning
Min uppsats handlar om samernas rättigheter, och framförallt om samernas markrättigheter. Syftet med min uppsats är att redogöra för samernas rättsliga utveckling i Sverige från den första renbeteslagen (RBL) fram till samernas ställning idag. Mina frågeställningar lyder: hur har samernas rättigheter sett ut genom tiderna? Hur ser samernas rättigheter ut idag och varför har inte Sverige ratificerat ILO:s konvention nr 169 om ursprungsfolk och stamfolk (ILO:s konvention)? Varför har samernas rättigheter sett ut på ett visst sätt?

Sammanfattning
Min uppsats handlar om samernas rättigheter, och framförallt om samernas markrättigheter. Syftet med min uppsats är att redogöra för samernas rättsliga utveckling i Sverige från den första renbeteslagen (RBL) fram till samernas ställning idag. Mina frågeställningar lyder: hur har samernas rättigheter sett ut genom tiderna? Hur ser samernas rättigheter ut idag och varför har inte Sverige ratificerat ILO:s konvention nr 169 om ursprungsfolk och stamfolk (ILO:s konvention)? Varför har samernas rättigheter sett ut på ett visst sätt?
Min första fråga besvarades genom att redogöra för hur samernas rättigheter såg ut innan RBL författades, därefter fortsatte jag att svara på frågan genom att förklara varför den första RBL kom till och hur den förändrade rättsläget. Jag har även med ett avsnitt om samernas organisationer och därefter avslutades min första fråga genom ett avsnitt om lagstiftning som följde efter den första lagen på området.
Min andra frågeställning valde jag att svara på genom att inledningsvis beskriva samerna i dagens Sverige och sen fortsätta med gällande lag, rennäringslagen (RNL). Jag tog även med ett kort avsnitt angående regeringsformen och FN:s konvention om politiska och medborgliga rättigheter, för att redogöra för hur dessa lagar ställer sig mot samernas rättigheter.
Min uppsats innehåller även en delfråga som handlar om ILO:s konvention och varför den inte har ratificerats. I kapitel fyra redogör jag för tre rättsfall, som jag tycker på ett eller annat sätt har klarlagt en del av samernas markrättigheter.
I sista kapitlet har jag placerat min analys. I analysen beskriver jag mina frågeställningar återigen och ger en redogörelse på vad jag har kommit fram till och vilka slutsatser jag har dragit av min uppsats. (Less)

My essay is about Sami rights, and mainly on Sami land right. The purpose of my paper is to describe the Sami legal development in Sweden from the first Reindeer Grazing Act (RGA) to the Sami's status today. My questions is: how has the rights of the Sami developed through the ages? What kind of rights do the Sami have today and why has not Sweden ratified the Indigenous and Tribal Peoples Convention, No. 169 (ILO Convention)? Why have the rights of the Sami developed in a certain way?

My essay is about Sami rights, and mainly on Sami land right. My first question I chose to answer by explaining how the rights of the Sami looked before the first RGA was written, then I proceeded to answer the question by explaining why the first RGA came about and what it changed. I have also included a chapter on Sami organizations and then I finished my first question with a section on legislation that followed the first law in the area.
My second question I decided to answer by first describing the Sami people in Sweden today and then continue with the current law, Reindeer Husbandry Act (RHA). I also took a short section regarding of the Instrument of Government and the International Convenant on Civil and Political Rights, namely to explain how the these laws stands against Sami rights.
I also have a sub query in my essay that deals with the ILO Convention and why it has not been ratified. In chapter four, I describe three cases, which I think in one way or another has clarified some of Sami land rights.
In the last chapter I have placed my analysis. In my analysis I describe my questions again and I give a description of what I have found and what conclusions I have drawn from my essay. (Less)
