Den positiva föreningsfriheten är en lagfäst grundläggande fri- och rättighet i Sverige, Finland och Tyskland. Många personer omfattas utav detta då de är eller har varit medlemmar i olika föreningar, möjligen i en idrottsförening som liten eller i en fackförening som arbetstagare. Föreningsfriheten ser näst intill identisk ut i de tre staterna, samt möjligheten att inskränka rättigheten enligt lag. Det som skiljer staterna åt är förfarandet då en förening uppnår rättskapacitet. I Sverige krävs inget särskilt förfarande när en förening skapas och uppnår rättskapacitet. Många personer omfattas utav detta då de är eller har varit medlemmar i olika föreningar, möjligen i en idrottsförening som liten eller i en fackförening som arbetstagare. Föreningsfriheten ser näst intill identisk ut i de tre staterna, samt möjligheten att inskränka rättigheten enligt lag. Det som skiljer staterna åt är förfarandet då en förening uppnår rättskapacitet. I Sverige krävs inget särskilt förfarande när en förening skapas och uppnår rättskapacitet. Det finns inte heller någon reglering gällande ideella föreningar i Sverige. Detta är en stor skillnad gentemot förfarandet och regleringarna i Finland och Tyskland. I dessa länder sker det en statlig kontroll och ett godkännande innan en förening registreras och uppnår rättskapacitet. Samtidigt finns det särskild lagstiftning för föreningar. Staten kan även kontrollera en förening efter det att den har registrerats, för att exempelvis undersöka så att föreningen följer sina stadgar. Dessa skillnader i förfarandet har alltså uppstått trots att föreningsfriheten i grunden är densamma för alla tre stater. Anledningen till dessa skillnader kan till viss del utrönas ur de olika staternas historia. Både Finland och Tyskland har medverkat i de världskrig som utspelat sig i Europa under 1900-talet, medan Sverige inte har medverkat. Sverige har dock under tiden mellan världskrigen samt under andra världskriget lagstiftat på sätt som har haft påverkan på den positiva föreningsfriheten. Dock har svenska lagstiftaren valt att upphäva dessa lagar efter andra världskrigets slut. I Finland och Tyskland har lagstiftaren gjort det motsatta. Där har lagstiftaren efter världskrigen lagstiftat på ett sätt som har gett staten kontroll över föreningarna. Genom detta har staten getts en kontroll som möjligen bidrar till att förhindra liknande händelser i framtiden. (Less)

Freedom of association is a fundamental freedom laid down in law in Sweden, Finland and Germany. Many people are affected by this freedom since they are or have been members of different associations such as a sports association or in a labor organization. The freedom of association is close to the same in all three states. This is also the case concerning the possibility to restrict the freedom, which all three states are allowed to do by law. The difference between the three states is the procedure when an association acquires legal capacity. There is no specific procedure for an association to acquire legal capacity in Sweden. The freedom of association is close to the same in all three states. This is also the case concerning the possibility to restrict the freedom, which all three states are allowed to do by law. Neither is there a specific regulation concerning non-profit associations in Sweden. This is a big difference compared to Finland and Germany. In these states the government executes a control before they register a new association. Legal capacity is then given to a registered association. Associations in Finland and Germany also have a specific law to follow after being registered. The government also has the possibility to control associations after their registration, and to see whether or not the association acts according to their own articles. These differences concerning the procedure of founding an association with legal capacity have occurred even though the freedom of association is close to the same in all three states. The reason for this difference may partially be found in the states histories. Both Finland and Germany have participated in the World Wars that have taken place in Europe during the 20th century, where Sweden has not participated. However, the Swedish legislator has chosen to legislate in areas where the freedom of association has been affected during these times. These legislations have however been abolished after the World Wars. In Finland and Germany the legislator has done the opposite. There the legislator has given the government means of controlling associations, which may prevent history from repeating itself. (Less)
