Abstract (Swedish)
(Less)

One of these negative aspects is that very recently people have started to use the possibility to hide behind a screen and anonymously violate people that they may never have met or ever will meet. The legislator has not been able to cope with the fast development. That has resulted in a conflict of interests between Freedom of Expression which is to be found in the Fundamental Law on Freedom of Expression and the protection of personal honor which is to be found in the fifth chapter Penal Code. The crimes that can be relevant according to the Penal Code are insult and defamation in both a normal and aggravated degree. The classification of a crime is affected in which way the violation is mediated and the intention behind.
Many people use their Freedom of Expression to justify violations that occurs on the Internet. Freedom of Expression is one of the most important conditions in a democratic society and therefore it has a very strong position in the legal system. The result of that is that other laws such as the Penal Code many times have to be put in perspective to the specific expression and thereby it may have to stand back. The Freedom of Expression is also protected by international conventions.
There are a lot of factors that makes this a difficult area to assess. Both the Fundamental Law on Freedom of Expression and the Penal Code are very old in their shape and were both established before the Internet had its big breakthrough in Sweden. That means that at the moment violations that occur on the Internet are being judged by laws that are not adapted to a modern society where the Internet has a central part. (Less)
