Internet har under det senaste årtiondet blivit ett modernt inslag i nästan varje människas vardag. Internet ger obegränsade kommunikationsmöjligheter, men det finns också ett antal negativa sidor med internets snabba utveckling i samhället. En av dessa negativa sidor är att folk under den senaste tiden har börjat utnyttja möjligheten att bakom en datorskärm anonymt kränka personer som de kanske inte ens har träffat eller någonsin kommer träffa. Lagstiftaren har inte hunnit med i den snabba utvecklingen. Internet har under det senaste årtiondet blivit ett modernt inslag i nästan varje människas vardag. Internet ger obegränsade kommunikationsmöjligheter, men det finns också ett antal negativa sidor med internets snabba utveckling i samhället. En av dessa negativa sidor är att folk under den senaste tiden har börjat utnyttja möjligheten att bakom en datorskärm anonymt kränka personer som de kanske inte ens har träffat eller någonsin kommer träffa. Lagstiftaren har inte hunnit med i den snabba utvecklingen. Det har resulterat till en intressekonflikt mellan yttrandefriheten som återfinns i yttrandefrihetsgrundlagen och skyddet för den personliga äran som återfinns i 5 kap Brottsbalken. De brott som kan bli aktuella enligt brottsbalken är förolämpning, förtal och grovt förtal. Brottsrubriceringen påverkas utav hur kränkningen förmedlas och avsikten bakom.
Många personer använder sin yttrandefrihet för att rättfärdiga kränkningar som sker på internet. Yttrandefriheten är en av de viktigaste förutsättningarna i ett demokratiskt samhälle och åtnjuter således en mycket starkt ställning i rättsordningen. Det leder många gånger till att andra lagar som brottsbalken måste ställas i perspektiv till det specifika yttrandet och därigenom eventuellt stå tillbaka. I Sverige skyddas även yttrandefriheten genom internationella konventioner.
Det finns många faktorer som gör detta till ett svårbedömt område. Både yttrandefrihetsgrundlagen och brottsbalken är ålderdomliga i sin utformning och etablerades innan internet fick sitt stora gemomslag i Sverige. Kränkningar som sker på internet bedöms alltså i nuläget utifrån lagar som inte är anpassade efter ett modernt samhälle där internet har en central roll. (Less)

The Internet has during the last decade become a modern feature in almost every person’s everyday life. The internet gives an unlimited possibility for communication, but there is also a number of negative aspects with the Internet’s fast development in society. That has resulted in a conflict of interests between Freedom of Expression which is to be found in the Fundamental Law on Freedom of Expression and the protection of personal honor which is to be found in the fifth... The Internet has during the last decade become a modern feature in almost every person’s everyday life. The internet gives an unlimited possibility for communication, but there is also a number of negative aspects with the Internet’s fast development in society. One of these negative aspects is that very recently people have started to use the possibility to hide behind a screen and anonymously violate people that they may never have met or ever will meet. The legislator has not been able to cope with the fast development. That has resulted in a conflict of interests between Freedom of Expression which is to be found in the Fundamental Law on Freedom of Expression and the protection of personal honor which is to be found in the fifth chapter Penal Code. The crimes that can be relevant according to the Penal Code are insult and defamation in both a normal and aggravated degree. The classification of a crime is affected in which way the violation is mediated and the intention behind.
Many people use their Freedom of Expression to justify violations that occurs on the Internet. Freedom of Expression is one of the most important conditions in a democratic society and therefore it has a very strong position in the legal system. The result of that is that other laws such as the Penal Code many times have to be put in perspective to the specific expression and thereby it may have to stand back. The Freedom of Expression is also protected by international conventions.
There are a lot of factors that makes this a difficult area to assess. Both the Fundamental Law on Freedom of Expression and the Penal Code are very old in their shape and were both established before the Internet had its big breakthrough in Sweden. That means that at the moment violations that occur on the Internet are being judged by laws that are not adapted to a modern society where the Internet has a central part. (Less)
