Sammanfattning
Europeisk likväl som nationell konkurrensrätt bygger på främjandet av effektiv konkurrens. För att uppnå denna effektiva konkurrens är det väsentligt att bekämpa och hindra horisontella samarbetsavtal som är konkurrensbegränsande och som har negativ effekt på samhällsekonomin och konsumenterna. I art. 101.1 FEUF samt 2 kap 1§ KL regleras det att dessa horisontella samarbetsavtal är förbjudna.

Förbudsbestämmelserna är parallellt tillämpliga, dock har EU:s konkurrensrätt företräde, och det är den berörda marknaden som avgör vilken förbudsbestämmelse som är tillämplig på ett otillåtet samarbetsavtal. Användandet av art. 101.1 FEUF är begränsat till avtal som kan påverka samhandeln mellan EU:s medlemsstater.

Europeisk likväl som nationell konkurrensrätt bygger på främjandet av effektiv konkurrens. Förbudsbestämmelserna är parallellt tillämpliga, dock har EU:s konkurrensrätt företräde, och det är den berörda marknaden som avgör vilken förbudsbestämmelse som är tillämplig på ett otillåtet samarbetsavtal. Användandet av art. 101.1 FEUF är begränsat till avtal som kan påverka samhandeln mellan EU:s medlemsstater.

Vidare innehåller förbudsbestämmelserna rekvisit om avtal. Detta begrepp inkluderar beslut av företagssammanslutningar och samordnade förfaranden. Avtalet ska likaså ha konkurrensbegränsande syfte eller effekt samt påverka konkurrensen på ett märkbart sätt.

Det finns vissa typer av horisontella samarbetsavtal som redan till sin natur anses skadliga och har därmed en märkbar påverkan på konkurrensen. Dessa typer av avtal kallas med andra ord Hard Core Cartels och omfattar prissamarbeten, marknadsuppdelning och produktion- och marknadsbegränsningar. (Less)

In order to obtain such effective competition it is essential to fight and prevent horizontal agreements that restricts practices and that have a negative effect on the economy and the consumers. In art. 101.1 of the treaty on the functioning of the European Union and chapter 2: article 1 KL it regulates that these horizontal agreements are prohibited.

Summary
European as well as national competition law is based on the promotion of effective competition. In order to obtain such effective competition it is essential to fight and prevent horizontal agreements that restricts practices and that have a negative effect on the economy and the consumers. In art. 101.1 of the treaty on the functioning of the European Union and chapter 2: article 1 KL it regulates that these horizontal agreements are prohibited.

The prohibition regulations are parallel applicable, however EU competition law has precedence, and it is the influenced market that determines which of the prohibition regulations that are applicable on an illegal agreement. The application of art. 101.1 of the treaty is limited to agreements which may affect trade between Member States.

Furthermore the prohibition regulations contain prerequisites concerning agreements. This notion includes decisions by associations of undertakings and concerted practices. The agreement should also have the object or result of restricting competition and affect the competition in a perceptible way.

There are some types of horizontal agreements that are found harmful by nature, and because of that have perceptible effect on the competition. These types of horizontal agreements are in other words called Hard Core Cartels and implicate price-fixing, market sharing and restrictions on markets as well as in production. (Less)
