Abstract
The purpose of the thesis is to examine the legal protection of a private sector employee who sounds an alarm about wrongdoings that take place in publicly funded enterprises. The purpose is also to examine how the legal protection could be strengthened.
The protection of employees who sounds an alarm about wrongdoings is complex and includes different legal rules, legal principles and areas of law. Employees who sounds an alarm about wrongdoings can face reprisals such as dismissal. In an employment there is an obligation for the employee to be loyal to the employer. An employee who sounds an alarm about wrongdoings can in some cases violate this obligation of loyalty. An employee who sounds an alarm about wrongdoings is protected by the freedom of speach in the European Convention on Human Rights. The protection of an employee who sounds an alarm about wrongdoings in media depends on the degree to which he or she has a constitutionally protected right to disclose information in the media. Employees are protected to some extent by Employment Protection
Act (lagen om anställningsskydd) and by principles in employment law. The legal protection of a private sector employee who sounds an alarm about wrongdoings is, however, significantly limited by 39 § Employment Protection Act giving an employer the opportunity to "buy out" a critical employee. Syftet med uppsatsen är att utreda vilket rättsligt skydd som finns för en privatanställd som slår larm om missförhållanden hos en arbetsgivare som bedriver offentligt finansierad verksamhet. Syftet är även att utreda hur det rättsliga skyddet skulle kunna stärkas.

Skyddet för arbetstagare som slår larm om missförhållanden är komplext och täcker in flera olika bestämmelser, principer och rättsområden. Skyddet för arbetstagare som slår larm om missförhållanden är komplext och täcker in flera olika bestämmelser, principer och rättsområden. Arbetstagare som slår larm om missförhållanden kan drabbas av repressalier som till exempel uppsägning. I ett anställningsförhållande har arbetstagaren en skyldighet att vara lojal mot arbetsgivaren. Arbetstagare som slår larm om missförhållanden skyddas genom yttrandefriheten som stadgas i den europeiska konventionen om de mänskliga rättigheterna. En arbetstagares skydd när arbetstagaren slår larm om missförhållanden i massmedia beror på i vilken grad han eller hon har ett grundlagsstadgat meddelarskydd. Arbetstagare skyddas i viss mån av LAS och arbetsrättsliga principer. Det rättsliga skyddet för arbetstagare som slår larm om missförhållanden begränsas dock avsevärt av 39 § LAS som ger en arbetsgivare möjlighet att ”köpa ut” en kritisk arbetstagare. (Less)
