Huvudregeln för påföljdsvalet i det svenska påföljdssystemet är att rätten ska fästa särskilt avseende vid omständigheter som talar för en lindrigare påföljd än fängelse. Fängelse är påföljdssystemet strängaste påföljd och skall väljas i sista hand. Som skäl för fängelse får domstolen enligt 30 kap. 4 § 2 st. beakta tre skäl: brottets straffvärde, brottets art och den tilltalades tidigare brottslighet.

Begreppet ”brottslighetens art” infördes i brottsbalken i och med 1989 års påföljdsreform och var tänkt att ersätta formuleringen ”med hänsyn till allmän laglydnad” i dåvarande 1 kap 7 § BrB som skäl för fängelse. Vad som menas med artbrott finns inte definierat varken i lagtext eller i förarbeten. Inte heller har lagstiftaren angett på ett uttömmande sätt vilka kriterier som kan ligga till grund för bedömningen om ett brott skall särbehandlas p.g.a. dess art. I förarbetena har det angetts att det handlar om brott som främst av allmänpreventiva skäl bör medföra ett kortare fängelsestraff. Grovt rattfylleri, jaktbrott, vapenbrott, mened, övergrepp i rättssak, våld mot tjänsteman, narkotikabrott är exempel på brottstyper i förarbetena ansetts kunna vara artbrott. Genom rättspraxis har ännu fler brottstyper kommit att klassas som artbrott, och i dagsläget går det att argumentera för att de flesta brottstyper i brottsbalken och specialstraffrätten i det enskilda fallet kan särbehandlas p.g.a. dess art. Hur stark presumtionen är för fängelse p.g.a. är olika beroende på vilken brottstyp det handlar om.

Artbrottskonstruktionen har utsatts för kritik i den juridiska doktrinen. De allmänpreventiva övervägandena som konstruktionen vilar på har ifrågasatts då det inte anses finnas empiriska belägg för konstruktionens allmänpreventiva effekter. Artbrottskonstruktionen har också kommit att kritiserat för att den är odefinierad och oklar. Det har lett till att domstolarna särbehandlat brott p.g.a. dess art på ”känsla”, vilket av kritikerna innebär att brottslingar döms till fängelse på ibland godtyckliga grunder.

I maj 2012 lade Påföljdsutredningen fram ett förslag där artbrottskonstruktionen utmönstras ur påföljdsbestämningen. I förslaget lyfts fram att påföljdsvalet ska grundas på straffvärdet och den tilltalades tidigare brottslighet, och att en särbehandling p.g.a. art inte är nödvändig i det nya påföljdssystem som utredningen föreslår. Imprisonment is the sanction system’s strictest penalty and shall be used only as a last resort. As reasons for imprisonment the court may only consider three factors: penal value, crimes with presumption for imprisonment (will be referred to by the Swedish term artbrott), and the defendant’s criminal record.

Referring to artbrott courts may decide to imprison a defendant even though neither the gravity of the crime nor the defendant’s previous criminal record dictates a jail sentence.

What is meant by artbrott is not defined in either text of law or in the preparatory work. Nor has the legislature listed in exhaustive manner criteria which can be the basis for determining whether a criminal offense shall be treated as an artbrott. The preparatory work stated that artbrott is a crime which, due to general preventive reasons, should result in a shorter prison sentence. Aggravated drunk driving, game laws offences, weapon offences, perjury, interference in a judicial matter, violence to public servant, and narcotic crimes are all examples of the types of crimes which the preparatory work has been considered to be artbrott. Through case law, even more types of crime have come to be classified as artbrott. In the current situation it is possible to argue that most types of crime in the Penal Code as well as in criminal legislation not included in the Penal Code can be treated as artbrott. The presumption of imprisonment differs depending on the crime committed.

The term artbrott has been criticized in the legal literature. The general crime prevention considerations method which the structure is built on has been questioned since it’s effectiveness has not been proved. Artbrott has also been criticized because it is undefined and unclear. It has led to the courts use of artbrott at one’s intuition. Critics argue therefore that offenders get sentenced to prison sometimes arbitrarily.

In May 2012 the Sanctions commission submitted a proposal where artbrott was discarded from the sanction system. The proposal highlighted that the choice of sanction should be based on the seriousness of the crime and the defendant’s criminal record, and that the use of artbrott is not necessary in the sanction system proposed by the commission.
