Ett narkotikafritt Sverige? Om kriminaliseringen av eget bruk av narkotika och stigmatisering

Den svenska narkotikapolitiken har sedan den andra halvan av 1900-talet varit föremål för en aktiv debatt. Det fastslagna målet för denna politik har varit ett narkotikafritt samhälle. För att uppnå detta mål har flera åtgärder vidtagits. En av dessa åtgärder var kriminaliseringen av eget bruk som skedde 1988 med en påföljande straffskärpning 1993.

Denna uppsats behandlar den svenska narkotikalagstiftningen och syftet är att utreda huruvida kriminaliseringen av eget bruk av narkotika var tillräckligt underbyggd för att kunna rättfärdigas vid sin tillkomst. Uppsatsen innehåller även en sociologisk del där stigmatisering av narkotikamissbrukare behandlas.

För att uppnå detta mål har flera åtgärder vidtagits. En av dessa åtgärder var kriminaliseringen av eget bruk som skedde 1988 med en påföljande straffskärpning 1993.

Denna uppsats behandlar den svenska narkotikalagstiftningen och syftet är att utreda huruvida kriminaliseringen av eget bruk av narkotika var tillräckligt underbyggd för att kunna rättfärdigas vid sin tillkomst. Uppsatsen innehåller även en sociologisk del där stigmatisering av narkotikamissbrukare behandlas.

Utifrån teorier gällande kriminalisering i allmänhet kan det anses råda tvivel om huruvida kriminaliseringen av eget bruk tilläts på för svaga grunder. Tveksamhet för dess rättfärdigande råder för såväl syfte, skyddsintresse, och effektivitet som för om kriminaliseringen utgör en moraliserande eller paternalistisk lagstiftning.

Utpekande av vissa gärningar som oönskade skapar normer i samhället. Om individer bryter mot dessa normer kan de riskera stigmatisering och att hamna utanför samhället. Denna sociologiska faktor har inte beaktats i svensk narkotikalagstiftning i någon högre grad. Det är dock viktigt att inte enbart beakta juridiska faktorer vid kriminaliseringar och kanske har stigmatisering i detta fall förbisetts i för stor utsträckning.

Den svenska narkotikalagstiftningen fungerar inte tillfredsställande och det finns behov för en förändring. Vad denna förändring bör utgöras av är svårt att säga. En möjlig förändring är att målsättningen om ett narkotikafritt samhälle överges. Oavsett vilken förändring som sker är det viktigt att ha andra perspektiv än enbart rent juridiska i åtanke. (Less)
Abstract
During the past 50 years, the Swedish drug policy has been hotly debated. The main objective of the policy is to create a drug-free society. Several measures have been taken to achieve this objective. One of these measures was the criminalization of personal consumption of drugs, which occurred in 1988, and the subsequent increase in the severity of the penalty in 1993.

This thesis deals with the Swedish legislation of drugs. The purpose of the thesis is to investigate whether or not, the criminalization of personal consumption of drugs was sufficiently substantiated to be justified at its establishment. The thesis includes a section from a sociological perspective, where the stigmatization of drug users is treated.

During the past 50 years, the Swedish drug policy has been hotly debated. The main objective of the policy is to create a drug-free society. Several measures have been taken to achieve this objective. One of these measures was the criminalization of personal consumption of drugs, which occurred in 1988, and the subsequent increase in the severity of the penalty in 1993.

This thesis deals with the Swedish legislation of drugs. The purpose of the thesis is to investigate whether or not, the criminalization of personal consumption of drugs was sufficiently substantiated to be justified at its establishment. The thesis includes a section from a sociological perspective, where the stigmatization of drug users is treated.

Based on theories regarding criminalization in general, it may be questioned whether the criminalization of personal consumption of drugs were approved on too weak legal grounds. Questions can be raised concerning the justification of the criminalization regarding purpose, the protection of interests and efficiency, as well as concerning whether the criminalization represents a moralistic or paternalistic legislation.

Designation of certain behaviors as undesirable creates norms in the society. If individuals violate these standards they may be exposed to stigma and social exclusion. This sociological aspect has not yet been considered in the Swedish legislation of drugs to a great extent. It is important to consider not only legal but also sociological aspects when a criminalization is implemented. Stigmatization may have been overlooked in extent, regarding the criminalization of personal consumption of drugs.

The Swedish drug policy does not work properly and there is a need for a change. What this change should be is difficult to tell. One potential change is to abandon the stated objective of a drug-free society. Regardless of the change that occur it is important to bear in mind other perspectives than just purely legal. (Less)
