- Abstract
- Citizenship as a condition of public work has gradually declined in importance in Sweden. The general rule in Swedish law is that persons with foreign citizenship shall be admitted to public employment but there are certain limitations to this principle by requiring Swedish citizenship for certain public positions. Those occupations that are of constitutional importance are defined in the Constitution. Other positions that also require Swedish citizenship are defined by law or by certain conditions specified in the law. This concerns occupations where the employee makes decisions affecting the legal status of individuals or occupations which are considered to be sensitive with regard to national security. - Citizenship as a condition of public work has gradually declined in importance in Sweden. The general rule in Swedish law is that persons with foreign citizenship shall be admitted to public employment but there are certain limitations to this principle by requiring Swedish citizenship for certain public positions. Those occupations that are of constitutional importance are defined in the Constitution. Other positions that also require Swedish citizenship are defined by law or by certain conditions specified in the law. This concerns occupations where the employee makes decisions affecting the legal status of individuals or occupations which are considered to be sensitive with regard to national security. Citizenship can be viewed as a contributing factor to a person’s loyalty, but it does not guarantee loyalty because there may be other beliefs and circumstances that also affect an individual. Citizenship requirements for employment should be based on tasks rather than on the job title because it creates a more uniform assessment. It is permitted by EU law for Sweden and other member states to make these derogations from the main rule of free movement of workers. However it might be possible to apply other criteria than Swedish citizenship for public employments, such as Union citizenship or domicile. (Less)

- I svensk rätt är huvudregeln att utländsk medborgare kan tillträda offentlig anställning i Sverige. Emellertid kan det göras inskränkningar mot denna princip genom att kräva svenskt medborgarskap för vissa offentliga anställningar. Yrken som är av konstitutionell betydelse kräver svenskt medborgarskap och dessa finns angivna direkt i regeringsformen. Andra inskränkningar får göras i lag eller förutsättningar som anges i lag. Krav på svenskt medborgarskap motiveras vid anställningar där arbetstagaren fattar beslut som rör enskildas rättställning eller som anses vara känsliga med hänsyn till rikets säkerhet. Frågan är om det finns en möjlighet att tillämpa andra kriterier än svenskt medborgarskap för offentliga anställningar som exempelvis domicilprincipen eller unionsmedborgarskap. Den offentligrättsliga arbetsrätten har begränsats samtidigt som medborgarskapet har minskat i betydelse. Det är därmed inte uppseendeväckande att medborgarskapet som villkor för offentlig anställning har gradvis försvunnit ut ur lagstiftningen. (Less)
