En av anledningarna till att Europeiska Unionen tilldelades Nobels fredspris år 2012 är den roll som organisationen har spelat för utvecklingen av mänskliga rättigheter i Europa, trots att det finns avsevärda oklarheter kring hur stort inflytande gällande rättigheter som EU faktiskt utövar. Med utgångspunkt i den normativa institutionalismens fokus på normers avgörande betydelse för hur organisationer formas syftar denna uppsats till att klargöra huruvida EU legitimeras som en auktoritet över nationell lagstiftning eller inte. En av anledningarna till att Europeiska Unionen tilldelades Nobels fredspris år 2012 är den roll som organisationen har spelat för utvecklingen av mänskliga rättigheter i Europa, trots att det finns avsevärda oklarheter kring hur stort inflytande gällande rättigheter som EU faktiskt utövar. Med utgångspunkt i den normativa institutionalismens fokus på normers avgörande betydelse för hur organisationer formas syftar denna uppsats till att klargöra huruvida EU legitimeras som en auktoritet över nationell lagstiftning eller inte. Genom att undersöka den svenska riksdagsdebatten angående diskrimineringslagstiftning analyseras förekomsten och utvecklingen av argument där EU tillskrivs en auktoritativ position. På detta sätt visas en klar förekomst av legitimering av EU. Denna legitimering blir dessutom något starkare över tid, vilket tyder på att det på nationell nivå sker en långsam utveckling mot att uppfatta EU som en auktoritet över medlemsstaternas lagstiftning. Undersökningen illustrerar även hur det mindre vanliga tillvägagångssättet av att undersöka språklig legitimering för att bättre förstå institutionell förändring kan användas för att studera själva europeiseringens process istället för att enbart dra slutsatser av dess effekter. One of the reasons that the European Union was awarded the Nobel peace prize in 2012 is the role that the organization has played for the development of human rights within Europe, even though there is a great deal of obscurity as for the extent of the influence regarding rights that EU is really exerting. With a starting point in the focus of normative institutionalism on the crucial significance of norms concerning the development of organizations, this essay aims to elucidate whether EU is being legitimized as an authority over national legislation or not. One of the reasons that the European Union was awarded the Nobel peace prize in 2012 is the role that the organization has played for the development of human rights within Europe, even though there is a great deal of obscurity as for the extent of the influence regarding rights that EU is really exerting. With a starting point in the focus of normative institutionalism on the crucial significance of norms concerning the development of organizations, this essay aims to elucidate whether EU is being legitimized as an authority over national legislation or not. By investigating the swedish parlamentary debate regarding the legislation on discrimination, the presence and the development of arguments where EU is ascribed an authoritative position is analyzed. In this way a distinct presence of legitimation of EU is displayed. This legitimation is furthermore getting somewhat stronger over time, which indicates that a slow development takes place on the national level towards an understanding of EU as an authority over the legislation of its member states. The examination also illustrates how the less common approach of investigating rethorical legitimation in order to better understand institutional change can be used to study the process of europeanization itself, instead of just drawing conclusions based on its effects.
