Innovation and mergers in the EU and the US - How should enforcement agencies take innovation effects into their merger analysis?

Abstract
This thesis will examine how innovation effects in merger cases are assessed in the EU and the US, with a brief comparison between these two systems, supported by guidelines and relevant case law mostly in the high-tech sector. It will establish that the two systems are similar in their assessment, however one can say that the US has been more future oriented and has included innovation market analysis in its assessment, whereas the EU is perhaps more case specific oriented. Discussion of existing problems will be examined and some suggestions will be made on how the enforcement agencies should address innovation effects in their merger analysis.
