Provokativa åtgärder är en effektiv metod som polisen främst använder vid grov
organiserad brottslighet. Det finns flera olika varianter av provokativa åtgärder, dock
ingen så omdiskuterad som brottsprovokation. Otillbörlig brottsprovokation innebär att
en polis eller en privatperson, som på uppdrag av polisen, har provocerat fram ett brott
av gärningsmannen som denne utan polisens inverkan inte hade begått. Faktorer som
har stor betydelse för bedömningen om otillbörlig brottsprovokation förekommit är
polisens handlande, den provocerades handlande och omständigheterna kring den
provocerades handlande.

Provokativa åtgärder är en effektiv metod som polisen främst använder vid grov
organiserad brottslighet. Det finns flera olika varianter av provokativa åtgärder, dock
ingen så omdiskuterad som brottsprovokation. Otillbörlig brottsprovokation innebär att
en polis eller en privatperson, som på uppdrag av polisen, har provocerat fram ett brott
av gärningsmannen som denne utan polisens inverkan inte hade begått. Faktorer som
har stor betydelse för bedömningen om otillbörlig brottsprovokation förekommit är
polisens handlande, den provocerades handlande och omständigheterna kring den
provocerades handlande.
Huruvida förekomsten av brottsprovokation kan påverka det efterföljande straffrättsliga
förfarandet och den enskildes rätt till en rättvis rättegång har flera gånger varit uppe för
bedömning i Europadomstolen. I målet Teixeira de Castro mot Portugal fastställde
domstolen att tillåtligheten av bevisning huvudsakligen är en nationell fråga och att
Europadomstolens roll främst är att bedöma om rättegången i dess helhet varit rättvis. I
domen klargjorde domstolen att det finns en gräns för hur polisen i konventionsstater får
använda sig av brottsprovokation för att inte bryta mot rätten till en rättvis rättegång och
artikel 6 § 1 i Europakonventionen.
Efter Europadomstolens utslag i Teixeira de Castro mot Portugal m.fl. avgöranden från
Europadomstolen valde Högsta domstolen i det s.k. Rembrandtmålet att fastställa hur
svensk rätt skulle bedöma frågan angående vad en otillbörlig brottsprovokation ska ha
för konsekvenser för den enskilde som provocerats. Högsta domstolen fastställde att
Europakonventionen inte förbjuder polisens användning av brottsprovokation utan
enbart lagföring av den provocerade gärningsmannen. Högsta domstolen kom fram till
att när brottsprovokation lett till att rätten till en rättvis rättegång blivit oåterkalleligen
undergrävd så ska domstolen avbryta det straffrättsliga förfarandet genom att lämna
åtalet utan bifall. Den provocerade undgår därmed straff. (Less) - Abstract

criminal activity. There are several variations of provocative action, however, none as
controversial as entrapment. Entrapment is considered to have occurred when a Police
Officer, or a private person acting on behalf of the police, incites the committing of an
offence that the offender otherwise would not have committed. Factors that have a
significant impact on whether entrapment has occurred are the police actions, the
provoked offender’s actions and the circumstances around the provoked offender’s
actions.

Officer, or a private person acting on behalf of the police, incites the committing of an
offence that the offender otherwise would not have committed. Factors that have a
significant impact on whether entrapment has occurred are the police actions, the
provoked offender’s actions and the circumstances around the provoked offender’s
actions.
The question of how entrapment may affect the criminal procedure and the individual’s
right to a fair trial has been subjected to the European Court of Human Rights several
times. In the judgment Teixeira de Castro v Portugal, the Court ruled, that the
admissibility of evidence primarily is a matter of national law and that the role of the
European Court is mainly to assess whether the trial, as a whole, is considered fair. In
this judgment, the Court noted that there are limitations to the police’s use of
entrapment in the States Parties to the European Convention to ensure that the right to a
fair trial and Article 6 § 1 in the European Convention, is not violated.
After the European Court rulings in cases such as Teixeira de Castro v Portugal, the
Swedish Supreme Court decided in the case of Rembrandt to establish how the Swedish
law interprets the effect of provocation on the individual. The Swedish Court
established that the European Convention does not prohibit the police’s use of
entrapment, only the prosecution of an offender who is considered provoked. The
Swedish Court found that where a provocation has ”irremediably undermined the
fairness of the trial” the trial will be stopped and the entrapped offender escapes
