- Denna uppsats behandlar svenska advokaters tystnadsplikt utifrån ett kritiskt och advokatideologiskt perspektiv. Uppsatsen redogör för vilka dessa advokatideologier är, vilka argument de grundas på och vilken effekt ideologierna har för tystnadsplikten.
Uppsatsen redogör för tystnadspliktens syfte, dess aktualiserande och dess olika motstående intressen. Uppsatsen redogör även för de lagar och regler som reglerar advokatens tystnadsplikt.
Därefter redogörs för olika fall där advokaten anklagas för att ha agerat i strid med tystnadsplikten.
Författarens egna synpunkter återfinns löpande genom texten samt i analysen.

This thesis covers the topic of Swedish lawyers and their legal obligation of client confidentiality. Throughout the thesis the topic is examined from a critical and a lawyer’s ideological point of view. The thesis also explains and examines the two major lawyers ideological standpoints as well as arguments for and against both.
The thesis explains the purpose of the lawyer’s client confidentiality, when it applies, various interests that it may come into conflict with and the applicable rules and laws that it is governed by.
The thesis also examines several cases where a lawyer is accused of not having acted in accordance with his obligation of client confidentiality.
The writers own opinion is present throughout the thesis as well as in the analysis.
The main question that this thesis aims to solve is how lawyers should act when unjust results may be the effect of the client confidentiality being maintained. (Less)
