- I uppsatsen undersöks metoderna socialnämnd och förvaltningsrätt använder för att bedöma behovet av omhändertagande av barn då det finns skäl att anta att ett behov av vård föreligger enligt LVU.
Socialstyrelsen har tagit fram en modell, kallad BBIC (barns behov i centrum) för att skapa ett enhetligt system för landets socialtjänster att arbeta efter när det kommer ärenden gällande barn. BBIC-metoden bygger på ett antal grundprinciper, den s.k. triangeln samt formulär, rutiner och möten.
När det kommer till huruvida förvaltningsrätterna arbetar utifrån en metod går en sådan att urskönja från de rättsfall som studerats. Metoden bygger på de rekvisit som ställs upp i lagstiftningen men grundas även på en del andra omständigheter som är... Vid en första anblick skiljer sig metoderna mycket åt men vid närmare granskning framträder en rad likheter när det kommer till metodernas bedömningsgrunder. De rekvisit som uppställs som grunder för bedömning i lagstiftningen och som domstolen använder sig av får anses motsvaras av de intressen som utgör grunden i BBIC-metoden och som ligger till grund för bedömningar utifrån denna.
Slutsatsen utifrån detta är att rättssäkerheten upprätthålls trots det faktum att även icke-juridiskt utbildad personal arbetar med avgöranden som grundar sig i lagstiftning. (Less) - Abstract

The National Board of Health and Welfare has established a model, BBIC (in rough, the child’s need in focus), to make the assessments regarding taking children into care a more uniform system. The model, or perhaps better rephrased to as the method, is structured by; a number of fundamentals, the Triangle, forms, routines and meetings.
The method used by the Administrative Courts is based on the elements established in the legislation and the legislative history.
At first the... (More) - This thesis is a study of the methods used by the Municipal Social Welfare Committee and the Administrative Courts when assessing if there is a need for compulsory care taking of children in accordance to The Care of Young Persons (Special Provisions) Act (LVU).
The National Board of Health and Welfare has established a model, BBIC (in rough, the child’s need in focus), to make the assessments regarding taking children into care a more uniform system. The model, or perhaps better rephrased to as the method, is structured by; a number of fundamentals, the Triangle, forms, routines and meetings.
The method used by the Administrative Courts is based on the elements established in the legislation and the legislative history.
At first the methods seem quite different, due to their diverse structures. However when studying the contents more thoroughly the realization of the many similarities intrigues. The elements established in the legislation are also the underlying interests behind the BBIC method.
In accordance with what has been stated, there is no reason of supposing that the Rule of law is breached due to the fact that non legally trained personnel make decisions based on legislation. (Less)
