- De straffrättsliga och de socialrättsliga regleringarna löper ofta parallellt i sin ambition att upprätthålla barnets grundläggande rättigheter till en trygg och säker uppväxt. I mötet mellan dess företrädare, i min text representerad av polis och socialtjänst, uppkommer inte sällan svårigheter när dessa regleringar ska tillämpas i en gemensam kontext. Projektet med Barnahus har hittills inte kunnat visa på att samverkansformen som sådan leder till att fler gärningsmän blir åtalade och dömda för brott mot barn. Däremot upplever inblandade parter, både de barn och föräldrar som verksamheten riktar sig mot och de inblandade yrkeskategorier som kommer i kontakt med verksamheten, att det finns stora fördelar med Barnahus. - De straffrättsliga och de socialrättsliga regleringarna löper ofta parallellt i sin ambition att upprätthålla barnets grundläggande rättigheter till en trygg och säker uppväxt. I mötet mellan dess företrädare, i min text representerad av polis och socialtjänst, uppkommer inte sällan svårigheter när dessa regleringar ska tillämpas i en gemensam kontext. Projektet med Barnahus har hittills inte kunnat visa på att samverkansformen som sådan leder till att fler gärningsmän blir åtalade och dömda för brott mot barn. Däremot upplever inblandade parter, både de barn och föräldrar som verksamheten riktar sig mot och de inblandade yrkeskategorier som kommer i kontakt med verksamheten, att det finns stora fördelar med Barnahus. Vidare visar min undersökning att den rättsliga handlingsplikt som finns för en vårdnadshavare att vara barnets primära beskyddar, ser något annorlunda ut i ett social- resp. straffrättsligt sammanhang. De juridiska normerna som legitimerar pliktens existens har skapats i olika kontexter och med skilda syften. Den gräns som man ur ett teoretiskt perspektiv står att finna blir dock inte lika skarp när normerna tillämpas i vardagliga beslut. Bestämmelser som finns uppställda till skydd för barnet i dennes kontakt med de båda myndigheterna är ibland svåra att kombinera, då deras övergripande syfte i hög grad skiljer sig från varandra. - Criminal and socialsecurity regulations are often parallel in their ambition in maintaining the child's basic rights to a safe and secure childhood . In the encounter between representatives for these two legal areas, in my essay exemplified by the police and social services, difficulties often arise when regulations shall be applied in an everyday context . Evaluations of the ”Barnahus”- project have not yet been able to show that the interaction between different authorities lead to a greater number of prosecutions, or that more offenders are convicted for crimes against children. However those involved, both children and parents, as well as the involved professionals, sees great advantages with Barnahus. Further my examination shows... (More)

In the encounter between representatives for these two legal areas, in my essay exemplified by the police and social services, difficulties often arise when regulations shall be applied in an everyday context . Evaluations of the ”Barnahus”- project have not yet been able to show that the interaction between different authorities lead to a greater number of prosecutions, or that more offenders are convicted for crimes against children. However those involved, both children and parents, as well as the involved professionals, sees great advantages with Barnahus. Further my examination shows that the guardians legal duty to act, beeing the child's primary shelter against all kind of abuse, differs between the two types of legal regulations. The legal norms that legitimize the existence of a duty is created in different contexts and with different aims . The border, that from a theoretical perspective is to be found, is not as sharp when applied on everyday decisions . Regulations established for the protection of the child in its contact with the two authorities are often difficult to combine, as their overall aim greatly differs from each other. (Less)
