Straffrättens roll angående sexualitet - En juridisk nutidsanalys av svensk våldtäktslagstiftning

Straffrättens roll och utformning angående våldtäkt har ifrågasatts och diskuterats de senaste årtiondena i Sverige. I takt med att samhället förändrats har också regleringen ändrats, för att komma att omfatta mer och mer. Genom att granska gällande rätt, juridiska diskussioner om en samtyckesreglering, statistik, viss praxis samt lämna ett större utrymme åt polisers uppfattningar ges en utblick i samhället för att se hur gällande rätt återspeglas och uppfattas. Uppsatsen behandlar även begreppet våldtäkt och problematiserar gällande rätt utifrån olika perspektiv och värderingar. Straffrättens roll och utformning angående våldtäkt har ifrågasatts och diskuterats de senaste årtiondena i Sverige. I takt med att samhället förändrats har också regleringen ändrats, för att komma att omfatta mer och mer. Genom att granska gällande rätt, juridiska diskussioner om en samtyckesreglering, statistik, viss praxis samt lämna ett större utrymme åt polisers uppfattningar ges en utblick i samhället för att se hur gällande rätt återspeglas och uppfattas. Uppsatsen behandlar även begreppet våldtäkt och problematiserar gällande rätt utifrån olika perspektiv och värderingar. Därför undersöks och diskuteras även lagens egentliga skyddsintresse, för att på så sätt senare kunna utröna hur väl det kan anses vara tillgodosett. Lagens normerande roll ifrågasätts och resonemang förs kring hur en alternativ lagstiftning bättre kan möta det samhälle vi lever i idag, för att på ett reellt sätt främja könsneutralitet och vidhålla sunda framtida sexuella normer där allas frivillighet är grundläggande. Särskilt fokus läggs vid ungdomar och deras syn på sexualitet, för att se de normer och värderingar unga i Sverige kan komma att bära med sig in i framtiden.

De slutsatser författarinnan kommit fram till är att straffrättens roll idag inte återspeglar den utveckling som sker i samhället och således borde lagens normbildande makt användas på ett bättre och tydligare sätt. Lagens egentliga skyddsintresse bör anses vara rätten att inte bli utsatt för påtvingade sexuella handlingar. För att mer effektivt tillvarata den rättigheten bör frivillighet tillsammans med en mer självklar sexuell integritet sättas i fokus även vid lagens utformning. En slags samtyckesreglering är påkallad, även om riktlinjer och normer behövs för att fylla ut begreppet ”frivillighet”. Att behålla begreppet våldtäkt med dagens innebörd uppfattas av författarinnan som ett utslag av konservatism från lagstiftaren. Då rätten varken är eller bör vara autonom i förhållande till samhället borde lagen moderniseras för att anpassas efter problematiken i just det: dagens samhälle, dessutom med särskild hänsyn till den problematik som återfinns bland ungdomar idag. Abstract
The role of criminal law regarding rape has been questioned and debated in the recent decades in Sweden. As society changed the law has been amended and become more comprehensive. By reviewing the existing law, undertaking legal discussions of a consent regulation, statistics and certain practices and by giving appropriate consideration to the views of the police, provides an opportunity for the community to see how the law is reflected and perceived. The essay also deals with the concept of rape and scrutinizes the law from different perspectives and values. Therefore it is necessary to examine and discuss what the law, actually intends to convey and to later determine how well it can be considered fulfilled or not. The law's normative... (More)
The role of criminal law regarding rape has been questioned and debated in the recent decades in Sweden. As society changed the law has been amended and become more comprehensive. By reviewing the existing law, undertaking legal discussions of a consent regulation, statistics and certain practices and by giving appropriate consideration to the views of the police, provides an opportunity for the community to see how the law is reflected and perceived. The essay also deals with the concept of rape and scrutinizes the law from different perspectives and values. Therefore it is necessary to examine and discuss what the law, actually intends to convey and to later determine how well it can be considered fulfilled or not. The law's normative standard is questioned and discusses how an alternative law can better meet the society we live in today. Further it seeks to promote the neutrality of gender and maintain healthy future sexual norms where everyone's free will is fundamental. Special focus is given to young people and their views of sexuality, to seek to establish the norms and values of young people in Sweden. These they may bring into the future.

The author’s conclusion is that the law does not reflect the developments of society and therefore, the law's normative power should be used in a better and clearer way. The main interest should be considered as the right not to be subjected to enforced sexual acts. In order to more effectively secure this interest, voluntary together with a more apparent sexual integrity should be considered and decisive when the law's created. A sort of consent regulation is warranted, even if guidelines and standards are needed to fill the concept of "free will". Retaining the concept of rape as it stands today is by the author seen as an expression of conservatism from the legislature. Since the law either is or should be autonomous in relation to society, it should be modernized to be able to adapt to the problems in today's society, this with a particular regard to the problems that are found among young people today.
