- Denna uppsats redogör för hur domstolen bedömer ett brotts straffvärde i narkotikamål. Detta innebär att domstolen ska visa den skuld gärningsmannen uppvisar genom den brottsliga gärningen och olika faktorer.
I början på 1960-talet var straffet för narkotikabrott böter eller fängelse i högst två år enligt NF. När NSL antogs höjdes dock straffmaximum till tio års fängelse då man var rädd för att Sverige skulle bli en ”fristad” för internationell langning. Ett decennium senare skärptes straffskalorna på nytt då minimistraffet för grovt narkotikabrott blev två års fängelse och maximistraffet för narkotikabrott av normalgraden blev tre års fängelse.

Genom åren har domstolarna försökt att nå en enhetlig rättstillämpning vid straffvärdebedömningar i narkotikamål. Detta gjorde att tabeller sammanställdes över praxis i narkotikamål. Efter millenniumskiftet så skapades Drogpraxisgruppen som fick i uppdrag att utarbeta riktlinjer för en enhetlig rättstillämpning på narkotikabrott som idag finns i boken, Studier rörande påföljdspraxis m.m. Än idag används dessa riktlinjer av domare vid narkotikamål.
Tidigare mätte domstolarna narkotikabrottens svårhet enbart genom mängden och sorten narkotika. Domstolarna beaktade inte vilket syfte som fanns bakom hanteringen av narkotikan, dvs. ”övriga omständigheter”. De övriga omständigheterna var tidigare avsedda vid beaktande av övre delen av straffskalan då de bl.a. indikerar om befattningen av narkotikan varit för eget bruk eller försäljning, till vilka försäljningen riktat sig till, om försäljningen varit en del av organiserad och internationell verksamhet etc.
Genom Mefedronfallet förändrades detta då HD beslutade att dessa övriga omständigheter skulle få större betydelse vid straffvärdebedömningen i narkotikamål. För att ett narkotikabrott ska få ett lika högt straffvärde som tidigare måste det alltså föreligga övriga omständigheter utöver mängden och sorten narkotika. Större utrymme skapades i straffskalan för de allvarliga brotten och efter förändringen har fler narkotikamål tagits upp för bedömning i HD. Den nya straffvärdebedömningen är i början på ett genomslag där nya tabeller skapats av Drogpraxisgruppen för att anpassa de rådande prejudikaten från HD.
Praxisomläggningen av HD har väckt flera frågor då det inneburit en förändring av hur påföljdsbestämningen i narkotikamål sker i praktiken vilket gett upphov till ett oklart rättsläge p.g.a. förhållandet mellan lagstiftning och praxis. Narkotikapolitiken i Sverige har fortfarande nollvisionen mot den illegala narkotikahanteringen men frågan är om nollvisionen fortfarande avspeglas i både lagstiftning och utdömda straff?
Tidigare kunde vissa narkotikabrott tendera i höga straff men en sammanställning av de rådande prejudikaten visar att HD fått en mildare syn. Avsevärt mycket lägre straff delas ut nu än tidigare. Förändringen har skett utan en debatt från lagstiftaren vilket skapat en spänning mellan domstolsnivån och lagstiftarnivån.
Den nya ordningen har försvårat arbetet för bl.a. åklagare och polis då de subjektiva rekvisiten får större betydelse än de objektiva i narkotikamål men rättspraxis har blivit mer rättvis och proportionerlig då rätta straff utdöms. HD har genom förändringen visat att de höga straffen inte minskar narkotikaproblemen i samhället. De vill att fokus ska läggas på de grövre och organiserade narkotikahandel. HD har alltså tagit en ställning i frågan och nu återstår att se vad lagstiftaren gör i nästa steg.
Vägen till ett narkotikafritt samhälle kommer att fortsätta vara lång och nästintill omöjlig men det är upp till lagstiftaren och domstolarna, tillsammans att försöka hitta den bästa lösningen för att minska narkotikaproblemen. (Less) - Abstract

punishment for narcotic offences were increased once again a decade later
as the minimum penalty for grave offences became two years inprisonment

of the law in regards to punishment in cases of narcotic offences, the
creation of charts representing case law in regards to the penalties was one
of the outcomes of this attempt. In the early years of the new millenium a
group was assembled to establish guidelines for the sentencing of persons
convicted of narcotic offences. These guidelines remain used to this day.
The charts, which became common practice to consult, measured only a
person’s guilt in terms of amount and what type of narcotics was in
question. The purpose of the possession of narcotics was not considered by
the courts. The purpose of the possession would only be considered in cases
of more grave narcotic offences.
The Supreme Court has since changed its established case law and now
considers the purpose of the possession as a vital part in determining the
penalty of the crime. The purpose can now act as an indicator of the more
grave narcotic offences. The change in the case law has also made it
necessary to review the established charts to ensure a uniform application of
the law.
Arguably, the new case law of the Supreme Court has not shed light on a
previously unclear area of the law but quite the opposite. The new case law
coupled with recent changes to the legislation has created an area of the law
in need of clarification.
The new case law by the Supreme Court has considerably lowered the
penalties for persons convicted of certain narcotic offences, despite the law
being the same. This has, understandably, created some friction between the
legislative body and the judicial body.
The new order has made work more difficult for prosecutors and the police
as subjective criteria are now being considered and given more weight. The
Supreme Court has made it clear that a stronger stance in narcotic offences
does not affect the problem of narcotics in society, but the change in case
law shows an attempt to target the more grave and organized trade in
narcotics. It is now time for the legislative body to step up to the plate.
The road to a society free of illegal narcotics is long and difficult, but it is
up to the legislative and judicial body to find solutions, together. (Less)
