Abstract (Swedish)
Syftet med denna uppsats är att utreda och analysera uteslutandebegreppet samt skillnaden mellan uteslutande och icke-uteslutande från flyktingskap och alternativt skyddsbehov enligt svensk lag och rättstillämpning och hur nationell rättstillämpning förhåller sig till internationell lag, doktrin och riktlinjer. För att åtskilja uteslutande och icke-uteslutande har det under arbetets gång framkommit att det är av vikt att fastställa vilka tillräcklighets- och beviskrav som är tillämpningsbara samt hur brotten som anges i uteslutandeparagraferna bör definieras. Resultatet av förevarande studie visar slutsatsen att den nationella rättstillämpning som har studerats förhåller sig väl till internationell lag, riktlinjer och doktrin över tid.

The aim of this essay is to investigate and analyze the term exlusion and the difference between exclusion and non-exclusion from refugee status and alternative protection status according to swedish asylum law and jurisprudence, and how the application of national law corresponds to international doctrine and guidlines. During the course of this essay it has been detected that when trying to draw a line between exclusion and non-exclusion it is of importance to investigate what standard of proof that is relevant to the application of the exlusion clauses, the question of individual responsability and also what defines the crimes stated therein.
