- I denna uppsats undersöks uppsalaskolans syn på rättighetsbegreppet med utgångspunkt i texter av Axel Hägerström, Vilhelm Lundstedt och Ingemar Hedenius. Syftet är att jämföra hur de tre författarna ser på rättighetsbegreppet. Uppsalaskolan har ofta framställts som en enhetlig rättsfilosofi, men i själva verket hade företrädarna skilda ståndpunkter i viktiga frågor. Alla tre författarna är i all väsentlighet anhängare av värdenihilismen, som säger att värderingar varken kan vara sanna eller falska eftersom de inte kan placeras in i tid och rum. - I denna uppsats undersöks uppsalaskolans syn på rättighetsbegreppet med utgångspunkt i texter av Axel Hägerström, Vilhelm Lundstedt och Ingemar Hedenius. Syftet är att jämföra hur de tre författarna ser på rättighetsbegreppet. Uppsalaskolan har ofta framställts som en enhetlig rättsfilosofi, men i själva verket hade företrädarna skilda ståndpunkter i viktiga frågor. Alla tre författarna är i all väsentlighet anhängare av värdenihilismen, som säger att värderingar varken kan vara sanna eller falska eftersom de inte kan placeras in i tid och rum. Utifrån denna ståndpunkt gick Axel Hägerström i polemik med en juridik och rättsvetenskap som han ansåg vara påverkad av den gamla tidens tankar om objektiva rättigheter. Vilhelm Lundstedt är i stort sett av samma åsikt som Hägerström, men ansåg att rätten skulle ses som ett uttryck för samhällsnyttan – det vill säga det som mänskligheten faktiskt eftersträvar och värderar i samhället. Ingemar Hedenius var också värdenihilist men delade inte den Hägerström-Lundstedtska kritiken om att rättigheter i själva verket inte ”finns”. Rättigheter existerar som en del av rättsordningen, argumenterade Hedenius, och uppsalaskolans tidiga företrädare tolkade begreppet rättighet på fel sätt. (Less)

- This paper examines the Uppsala school of thought’s (Uppsalaskolans) approach to the concept of rights. The investigation is based on texts by the three legal philosophers Axel Hägerström, Vilhelm Lundstedt and Ingemar Hedenius. The Uppsala school of thought has often been presented as a coherent philosophy of law, but the representatives in fact held differing positions on a number of important issues. Each of the three authors presented in this paper are supporters of value nihilism, saying that values can be neither true nor false since they cannot be placed within the dimensions of time and space. - This paper examines the Uppsala school of thought’s (Uppsalaskolans) approach to the concept of rights. The investigation is based on texts by the three legal philosophers Axel Hägerström, Vilhelm Lundstedt and Ingemar Hedenius. The Uppsala school of thought has often been presented as a coherent philosophy of law, but the representatives in fact held differing positions on a number of important issues. Each of the three authors presented in this paper are supporters of value nihilism, saying that values can be neither true nor false since they cannot be placed within the dimensions of time and space. From this theoretical standpoint Axel Hägerström argued against the Swedish law and jurisprudence, which he perceived as being influenced by the old-time thoughts about the existence objective rights. Lundstedt basically held the same position as Hägerström, with the exception that he viewed law as an expression of the common good - that is what humanity actually seeks and values in society. Hedenius was also a supporter of value nihilism but did not share Lundstedt and Hägerströms criticism that rights do not actually “exist”. Hedenius instead argued that rights exist as a part of the legal system, and that the early representatives of Uppsala school of thought had interpreted the term “right” the wrong way. (Less)
