Summary
The Syrian refugees coming to Europe is a big challenge for the member states in the European Union. The situation in Syria has led to many millions of Syrians have fled their country of origin and they seek protection in nearby countries and in Europe. The European Union is facing a big problem in finding a solution for all these Syrians coming to Europe. During the last year, 2013, it happen a lot of accidents when refugees who tried to reach Italy, drowned outside the Italian coast.
Many of the accidents happened near the Italian island Lampedusa. In EU there are discussions

Summary
The Syrian refugees coming to Europe is a big challenge for the member states in the European Union. The situation in Syria has led to many millions of Syrians have fled their country of origin and they seek protection in nearby countries and in Europe. The European Union is facing a big problem in finding a solution for all these Syrians coming to Europe. During the last year, 2013, it happen a lot of accidents when refugees who tried to reach Italy, drowned outside the Italian coast.
Many of the accidents happened near the Italian island Lampedusa. In EU there are discussions
about how legal ways for refugees can be made and how accidents like these can be avoided.This thesis is about Italy's asylum system. The main purpose of this thesis tries is to find out whether Italy lives up to the regional standards on human rights concerning Italy's treatment of Syrian refugees. The first question is about Italy and if Italy takes its responsibility under the Dublin II Regulation. A second question is if there are parts of Italy's asylum system that does not
correspond with the requirements in EU's asylum directives and regulations?
A third question this thesis is trying to answer is whether the readmission agreements Italy has
signed with Libya and Egypt are compatible with the international principle of non-refoulement.
The conclusion is that Italy seems to be more interested in getting rid of the asylum seekers coming
to the border, than protecting them and let those seek asylum. It also seems like the asylum system
in Italy is a chaotic system and not compatible with the international and regional standards for
refugees. Regarding the readmission agreements, it is positive that Italy doesn’t ́ t send back any
asylum seekers to Libya's border any more. The agreements with both Libya and Egypt are still in function and have risen concerned from human rights organizations mainly concerning safety
aspects of the asylum seekers in the agreements. Both Libya and Egypt are not safe countries for
asylum seekers and it is not in accordance to the refoulement principle to send asylum seekers to neither Libya or Egypt. (Less)

EU står inför en stor utmaning att kunna ta emot alla flyktingar som är på flykt. Idag är det främst de syriska flyktingar som är på EU:s agenda. Situationen i Syrien har tvingats miljontals människor på flykt och EU har ett stort ansvar att ta hand om de syriska flyktingar som kommer till dit. I EU pågår därför ett intensivt arbete att hitta lösningar på flyktingproblematiken, för att kunna rädda flyktingar ute till havs och för att kunna skapa lagliga vägar till Europa. Under förra året, 2013,

Dessa händelser har varit en bidragande orsak till arbetet att skapa en bättre och rättvisare asylpolitik haft stort fokus.Denna uppsats handlar om Italien och huruvida Italien lever upp till de krav som ställs
internationellt samt EU-rättsligt på asylrättsområdet. Frågan besvaras utifrån tre områden. Den första är om Italien tillämpar Dublinförordningen gällande de syriska flyktingarna. Den andra frågan är om det finns det delar av Italiens asylsystem som inte uppfyller minimikraven i EU-instrumenten på asylrättsområdet. Till sist ska även uppsatsen besvara om återtagandeavtalen
Italien ingått med Libyen och Egypten är förenliga med non-refoulement principen i internationell
rätt. Sammanfattningvis verkar det som att Italien inte vill ta emot asylsökande i landet. Deras
flyktingpolitik verkar mer handla om att undkomma ansvaret enligt Dublinförordningen genom att
inte registrera flyktingar. Italiens asylsystem kan beskrivas som ett kaosartat system, som inte
uppfyller de internationella och EU-rättsliga kraven. Italien har skärpt till sig och sänder i dag inte tillbaka asylsökande till Libyen. Återtagandeavtalen med Libyen och Egypten finns fortfarande kvar och har väckt uppmärksamhet främst gällande säkerhetsaspekterna i avtalen. Det verkar inte finnas några bestämmelser i respektive avtal som garanterar asylsökandes skydd från refoulement. Varken Libyen eller Egypten är säkra länder i nuläget för asylsökande enligt både UNHCR och Amnesty
och att sända någon dit till dessa länder är inte förenligt med non-refoulement principen. (Less)
