Abstract
While investigating a crime, the Swedish judicial system often applies restrictions on prisoners remanded in custody. The main purpose of this is to make the criminal investigation more efficient and minimize the risk of evidence being eliminated. While investigating a crime, the Swedish judicial system often applies restrictions on prisoners remanded in custody. The main purpose of this is to make the criminal investigation more efficient and minimize the risk of evidence being eliminated. Sweden is being criticized for their treatment of individuals deprived of their freedom, this by the European committee for the prevention of torture (CPT) amongst others because of the fact that isolation causes mental illness. Based on the fact that the mental health is affected, the purpose of this study was to investigate how the application of restrictions affects the inmate and how the inmate is handling the situation in custody. This study is based on five qualitative interviews with five men who have previously been detained in custody. All five interviews were conducted by telephone or face to face. The theory I have used to analyze the study is Goffman's Total institutions. I have also used Olof Petersson's definitions of the concept of power. The methodological approaches used were social. The results shows that various factors such as a recognized criminal lifestyle, earlier experiences from isolation in custody but also a long-lasting and widespread drug abuse can influence how the prisoner will react to isolation. It also shows that a person who lives in orderly social conditions, with no previous experience of incarceration, who suffers a long and intensive detention in isolation increases the risk of negative impacts on mental health. The more intense and prolonged the restrictions are, the more difficult it can be for the individual to readjust oneself once outside. All five interviewees remarked that the lack of humane contact during isolation is the most distressing factor during isolation in remanded custody. (Less)
