Sammanfattning
Detta examensarbete kommer att handla om relationen mellan den svenska åklagarmyndigheten och den europeiska åklagarmyndigheten med rättssäkerhet/effektivitet som examensarbetets teoretiska verktyg. En mycket viktig sak som måste påpekas är att den europeiska åklagarmyndigheten ännu ej finns, men EU är mycket angeläget om att inrätta myndigheten. Å ena sidan vill EU inrätta myndigheten, men å andra sidan finns de medlemsstaterna som ser åtskilliga betänkligheter i form av konflikter med de grundläggande principer som den europeiska åklagarmyndigheten för med sig. Detta examensarbete kommer att handla om relationen mellan den svenska åklagarmyndigheten och den europeiska åklagarmyndigheten med rättssäkerhet/effektivitet som examensarbetets teoretiska verktyg. En mycket viktig sak som måste påpekas är att den europeiska åklagarmyndigheten ännu ej finns, men EU är mycket angeläget om att inrätta myndigheten. Å ena sidan vill EU inrätta myndigheten, men å andra sidan finns de medlemsstaterna som ser åtskilliga betänkligheter i form av konflikter med de grundläggande principer som den europeiska åklagarmyndigheten för med sig. Därför fungerar medlemsstaterna som en motvikt gentemot EU:s makt. I skrivande stund är det tillika medlemsstaterna som har övertaget. En beskrivning av projektet med den europeiska åklagarmyndigheten och relationen gentemot åklagarmyndigheten i Sverige kommer genomföras. EU:s förvaltning och Sveriges förvaltning ter sig högst olika. Det som gör ämnet intressant är alltså skillnaden mellan hur ett beslut drivs igenom i en konfederation och i en enhetsstat. I enhetsstaten Sverige är det tämligen enkelt. Enhetsstaten har en centralmakt där makten sedan delas upp i de olika samhällsnivåerna ända ut i periferin. Vill Sveriges styrande elit att en förändring skall komma till stånd så blir det i bästa fall en ny lagstiftning med kompromisser mellan de olika politiska partierna i riksdagen. Europeiska Unionen, som enligt författarna Ann Ward och Lee Ward mest liknar en konfederation, har det betydligt tuffare2. Fördragstext måste utformas noga så att den blir tilltalande för så många medlemsstater som möjligt. Därför är fördragstext en kompromiss mellan alla medlemsstaterna i konfederationen i fråga. I viktiga frågor krävs enhällighet för att ett beslut skall kunna fattas, i andra frågor räcker det med kvalificerad majoritet. Frågan om fördragstext i Fördraget om Europeiska Unionens Funktionssätt var naturligtvis en sådan viktig fråga som krävde enhällighet, vilket det också blev till slut även om medlemsstaten Irland länge obstruerade. Vissa artiklar i detta fördrag föreskriver att beslut skall fattas med enhällighet, däribland inrättandet av en europeisk åklagarmyndighet i artikel 86. En enda medlemsstat i ministerrådet kan alltså ställa förslaget på ända. I fördraget finns artiklar som är centrala för denna examensuppsats – artiklarna om straffrättsligt samarbete som omnämns i artiklarna 82 till 86. Enligt FEUF artikel 86 skall EÅM baseras på Eurojust. (Less)

This bachelor thesis will deal with the relation between the Swedish and the European public prosecutor’s offices with the pair legal security/efficiency as theoretical instruments. A very important thing that has to be pointed out is that the European public prosecutor’s office does not yet exist, although the European union is very eager to set up this authority. On one hand the European union wants to set up the authority, but on the other hand the member states notice several issues as in conflicts with rudimentary principles that are brought with the setup of the European public prosecutor’s office. This bachelor thesis will deal with the relation between the Swedish and the European public prosecutor’s offices with the pair legal security/efficiency as theoretical instruments. A very important thing that has to be pointed out is that the European public prosecutor’s office does not yet exist, although the European union is very eager to set up this authority. On one hand the European union wants to set up the authority, but on the other hand the member states notice several issues as in conflicts with rudimentary principles that are brought with the setup of the European public prosecutor’s office. Therefore the member states function as a counterbalance against the power of the European union. As for today, it is also the member states that are the stronger counterbalance. Further on in this bachelor thesis a description of the project of the European public prosecutor’s office and its relation to the Swedish public prosecutor’s office will be presented. The administrations of the European union and the state of Sweden appear to be very different. What makes this subject so interesting is therefore the difference of how decisions are enforced in a confederation and a unitary state. In Sweden it is somewhat simple. The unitary state has all the power centralized in a small unit, from which the power is distributed all the way to the society’s periphery. If the Swedish ruling elite wants to make a change for something, then at its best, a new law will be enacted out of compromises between the parties of the parliament. The European union, which best is described as a confederation according to the authors Ann Ward and Lee Ward, does have a lot more difficulties1. The text of a treaty has to be given a final shape to closely, so that it becomes as acceptable as possible to the member states. Therefore the text of the treaty is compromises between all the member states of the confederation in question. When it comes to an important question, unanimous votes are required for a decision to be made. Otherwise it is sufficient with a two-third majority. Of course the question about the text of the function treaty of the European union was such an important question that required absolutely unanimous votes. That was also finally the case even though Ireland persistently put gongs on the chances. Also some of the articles in the function treaty dictate unanimous votes. The setup of the European public prosecutor’s office dictated in article 86 is such kind of an example among specific articles. One single member of the Council might therefore as well put a gong on the chances for a proposal. In the function treaty there are articles, which are very important for this bachelor thesis – the articles 82 – 86 about cooperation in criminal law matters. According to TFEU 86, EPPO shall be based on Eurojust. (Less)
