Abstract
While the Swedish legal anti-discriminatory framework was extended to include the educational system in 2006, differences in elementary school results are continually growing. This raises questions about the ambitions and effectiveness of the school system’s anti-discrimination policies, which are framed as equal treatment. This study investigates the normative underpinnings of the concept of equality in the political regulation of equal treatment practices in Swedish elementary schools. While the Swedish legal anti-discriminatory framework was extended to include the educational system in 2006, differences in elementary school results are continually growing. This raises questions about the ambitions and effectiveness of the school system’s anti-discrimination policies, which are framed as equal treatment. This study investigates the normative underpinnings of the concept of equality in the political regulation of equal treatment practices in Swedish elementary schools. Drawing upon intersectional theory, discourse theory and a critical approach to policy analysis, the study examines the legal and regulatory framework. Focusing on the model of justice and the representation, constitution and positioning of “equality”, the study concludes that the framework for equal treatment in elementary schools is rooted in the concept of human rights. Justice and equality are conceptualized in highly individualistic terms. The Swedish school system, as well as the Swedish state, are discursively constructed as embodying values of equality, human rights and democratic principles. The problem of and the solution to discrimination are thus placed among the students themselves rather than in the structural marginalizing processes of the education system. (Less)
