Responsibility to Protect - Vems skyldighet?

Uppsatsen behandlar frågorna angående vad skyldigheten som följer av R2P innebär och vem skyldigheten läggs på. Frågorna är viktiga för förståelsen och tillämpningen av R2P, oklarheter leder till att doktrinen blir svårtilläm-pad. R2P ska inte innebära en ny skyldighet, utan ska grunda sig på redan existerande internationell rätt. För att R2P ska få så stark effekt som möjligt bör den innebära en rättslig skyldighet och inte en moralisk eller politisk. Det mesta tyder på att R2P inte innebär någon rättslig skyldighet men dokt-rinen är fortfarande under utveckling och det är möjligt att dess status kan komma att ändras i framtiden.

Enligt R2P-dokumenten ska världssamfundet ha en skyldighet att skydda. Världssamfundet är, inom juridiken, ett vagt begrepp som skapar en del för-virring angående vem det är som ska intervenera vid en R2P-situation. Sä-kerhetsrådet, organisationer och stater är alla aktörer som omnämns i de do-kument som finns angående R2P. Att lägga en rättslig skyldighet på någon av dem verkar dock inte vara möjligt i dagsläget då det inte går att hitta nå-gon grund för det i redan existerande internationell rätt. R2P kan inte heller innebära en rättsligt bindande skyldighet genom statusen av internationell sedvanerätt, eftersom det inte finns någon fullt utvecklad statspraxis eller opinio juris.

Sammanfattningsvis är innebörden av skyldigheten som R2P skapar odefi-nierad. Troligtvis är tanken att den skall vara rättsligt och att det skall finnas en skyldighetsbärare, vilken inte har uppnåtts i dagsläget. (Less)

The essay discusses the questions concerning the responsibility that derives from R2P. The two main questions concern the meaning of the responsibil-ity and which actor has got the main responsibility. The questions are im-portant for the understanding of the application of R2P, because ambiguity leads to difficulties during application. R2P does not result in a new respon-sibility, it derives from already existing international law. For the doctrine to be as powerful as possible it should be a legal responsibility, not a moral or political. Most of the information and research tend to indicate that no such legal responsibility exists. The doctrine is still under development and it is possible that its status will change in the future.

According to the R2P-documents it is the international community who has got the responsibility to protect. The international community is a vague term that tends to cause confusion regarding who should intervene in an R2P-situation. The Security Council, organizations and states are all actors mentioned in the R2P-documents. Because of the lack of support in existing international law it does not seem to be possible to place a responsibility on either of them. Furthermore R2P cannot result in a legal responsibility through international customary law because there is no proven state prac-tice or opino juris.

The meaning of the responsibility that R2P creates is undefined. It might be supposed to be a legal responsibility and a defined carrier of the responsibil-ity. However this is not accomplished yet. (Less)
