Allt fler människor blir infertila. För att lösa problemet att få ett genetiskt barn har flera länder i vår omvärld börjat använda och tillåta surrogatmödraskap. I Sverige har åsikterna tidigare varit att det varit en allt för oetisk metod. Under årens lopp har dock värderingarna ändrats något och idag pågår en livlig debatt om altruistiskt surrogatmödraskap ska bli tillåtet. Altruistiskt surrogatmödraskap innebär att en kvinna ställer upp att vara gravid och föda ett barn åt en vän eller släkting utan betalning. Det vanligaste är att den ofrivilligt barnlösas ägg befruktas utanför kroppen och sedan förs in i en annan kvinnas livmoder, surrogatmoderns.

I Sverige har åsikterna tidigare varit att det varit en allt för oetisk metod. Under årens lopp har dock värderingarna ändrats något och idag pågår en livlig debatt om altruistiskt surrogatmödraskap ska bli tillåtet. Altruistiskt surrogatmödraskap innebär att en kvinna ställer upp att vara gravid och föda ett barn åt en vän eller släkting utan betalning. Det vanligaste är att den ofrivilligt barnlösas ägg befruktas utanför kroppen och sedan förs in i en annan kvinnas livmoder, surrogatmoderns.
Surrogatmödraskap väcker många juridiska och etiska frågor då det är en metod där man med teknikens hjälp och genom att använda en annan kvinnas kropp får fram ett genetiskt barn åt någon annan. Uppsatsens syfte är att undersöka vilka olika intressen som vägs mot varandra i debatten om surrogatmödraskap och vilka rättsliga problem som kan medfölja vid en legalisering. De frågeställningar som ska besvaras är vilka intressen som väger mot varandra från barnens respektive surrogatmoderns perspektiv och om vi bör legalisera surrogatmödraskap.
Ur barnets perspektiv vet vi än så länge väldigt lite om hur det påverkas. Barnet kan själv inte vara med och samtycka till processen, därför är det väldigt viktigt att framtida fysiska och psykologiska risker beaktas. Barnets bästa ska alltid eftersträvas vilket FN:s barnkonvention anger. Många är rädda för att det ska uppstå en barnhandel om surrogatmödraskap legaliseras. De flesta är dock överens om att ett altruistiskt surrogatmödraskap inte bör leda till barnhandel då inga pengar är involverade. Dock så finns det de som hävdar att även ett altruistiskt kan leda till en barnhandel i det dolda.
Ur surrogatmoderns perspektiv finns det de som hävdar att det skulle strida mot människovärdesprincipen genom att surrogatmodern används som ett medel för att få fram ett barn. Surrogatmodern har som alla andra självbestämmanderätt att besluta hur hon väljer att leva sitt liv. Oroliga åsikter finns dock om surrogatmoderns självbestämmande egentligen kommer i från påtryckningar från vänner och släktingar.
I uppsatsen argumenteras för att en legalisering ännu inte borde införas med hänsyn till barnens intressen men även surrogatmoderns. (Less) - Abstract

In Sweden, the previously held view was that surrogacy is unethical. However, over the years societal values have begun to gradually change. Presently there is a lively debate concerned with allowance of altruistic surrogacy. Altruistic surrogacy involves a woman becoming pregnant and giving birth on behalf of a friend or relative without receiving payment. Usually, an egg from the woman that cannot have a child but wishes to have one is fertilized outside her body and placed inside the surrogate mother’s womb.

In Sweden, the previously held view was that surrogacy is unethical. However, over the years societal values have begun to gradually change. Presently there is a lively debate concerned with allowance of altruistic surrogacy. Altruistic surrogacy involves a woman becoming pregnant and giving birth on behalf of a friend or relative without receiving payment. Usually, an egg from the woman that cannot have a child but wishes to have one is fertilized outside her body and placed inside the surrogate mother’s womb.
Surrogate motherhood raises many legal and ethical issues as it is a method where technology is used as well as another woman´s body to develop a genetic child for someone else. The aim of this essay is to understand the various interests at play in the debate over surrogacy and the legal problems that can accompany the legalisation.
Taking the child’s perspective we know little about how they are affected. The child cannot agree to the process itself so it is very important to take future physical and psychological risks into account. The child’s best interests should always be sought after, which is also stipulated by the United Nation’s Convention on the rights of the child. Many fear that child trafficking could increase if surrogacy is legalized. Others argue that the altruistic surrogacy will not lead to child trafficking as money is not involved. However, the argument that even altruistic surrogacy could lead to child trafficking in secrecy has also been put forward.
Taking the surrogate mother’s perspective many argue that human dignity is violated when a surrogate is used to procure a child. She, just like anybody else, has the right to determine herself how she wants to live her life. There is an argument that a woman can be pressured into surrogacy by friends and relatives.
In this essay I argue that surrogacy should not be legalized, as it does not concur with the best interests of the child or the surrogate mothers. (Less)
