Flygbombningar inleddes över Kosovo och stora delar av nuvarande Serbien den 24 mars 1999. Attacken fördes av Nordatlantiska fördragsorganisationen under kodnamnet Operation Allied Forces Nordatlantiska fördragsorganisationen valde att agera för att få ett stop på de kränkningar som den jugoslaviska regeringen utövade mot kosovoalbanerna och för att förbättra den humanitära situationen för kosovoalbanerna. Interventionen ansågs dock av flertalet författare däribland Peter Hilpold och Allen Buchanan som rättsstridig då den skett på eget bevåg utan auktorisering från FN:s säkerhetsråd. Trots det sågs operationen som legitim och den rättfärdigades både av NATO men även av flertalet stater.

Uppsatsen undersöker vilka argument som användes av NATO och vissa stater för att legitimera våldsanvändningen i Kosovo. En grundlig framställning görs av relevanta resolutioner, doktrin och artiklar för att uppfylla syftet med uppsatsen och svara på frågeställningarna. De två frågor som ska besvaras är hur interventionen legitimerades och om den de facto var legitim. I slutet av uppsatsen finns en analys där en sammanställning görs av de argument som använts och varit mest framträdande för att lättare se hur en legitimering kunde ske. Uppsatsen avslutas med att jag redovisar min kritiska ståndpunkt till interventionen i Kosovo och en slutsats angående vilka konsekvenser interventionen hade och fortfarande har. (Less)

On the 24 of March 1999 a bombing campaign began over Kosovo and large parts of present Serbia. The attack was carried out by the North Atlantic Treaty Organization under the code name Operation Allied Forces. The reason for intervening was to put a stop to the assaults that the Yugoslav government exercised against the Kosovo Albanians but also to improve the humanitarian situation in Kosovo. The intervention was considered by numerous authors including Peter Hilpold and Allen Buchanan as unlawful because it occurred without authorization from the UN Security Council. Nevertheless it was seen as a legitimate operation and it was legitimized both by the North Atlantic Treaty Organization, a majority of states and other organizations.

This essay examines the arguments that were used by the North Atlantic Treaty Organization and nations to legitimize the use of force in Kosovo. A thorough presentation of relevant resolutions, doctrine and articles is made to fulfill the purpose of the essay and to answer my questions. My questions are how the use of force was legitimized and if in fact it was legitimate. At the end of the essay is an analysis with a recapitulation of the arguments that have been used and have been the most salient. This is to more easily examine how the legitimation was possible. The essay later concludes with a presentation of my critical view on the intervention and my opinion on the impact that the intervention had and still has. (Less)
