- Abstract
- This essay compares two pieces of legislation, their backgrounds and political processes, in order to highlight the interrelation between social and legal developments.
The subject that I have chosen to explore is men’s violence against women, and the two legal amendments which shall be analysed and compared are the criminalisation of marital rape and violence against women.
Through this comparison I shall present the connection between women’s social and legal standings, within the theoretical lens of feminist theoretical models of male dominance and female subservience, and an understanding of how such factors affect women’s protection under the law.

Furthermore, the differences in the political debate which arose during the legal amendments shows a development towards stronger protection, not simply under the letter of the law, but also through the way that society understands and reacts to gender based power asymmetry.
Finally, I argue that feminist explanation theories should be incorporated in the forming and understanding of the law in a wider sense, in order to get an application that is true to reality. (Less) - Abstract (Swedish)

Också skillnaderna i den politiska debatten under lagändringarna visar på en utveckling mot ett starkare skydd, inte bara straffrättsligt genom själva brottsbeteckningen utan också i den allmänna förståelse om manlig och kvinnlig maktfördelning.
Jag argumenterar slutligen för att feministiska förklaringsteorier bör inkorporeras i utformningen och förståelsen av lagar och straffrätt i allmänhet, för att få en så verklighetstrogen tillämpning som möjligt. (Less)
