Abstract
Mass Rapes in Bosnia-Herzegovina illustrated the structural sexual violence in war and made it hypervisible. Despite the fact that 111 cases involving sexual violence during the war are being heard in the court of Bosnia and Herzegovina only thirty-six cases have been completed. Sara Sharratt’s theory argues that all institutions in society including the courts are affected by the stereotypes and prejudices that are prevailing in society, of women and sexual violence between the genders. She argues that the society puts labels on rape victims based on prejudices. These prejudices affect the court members and thus the court judgments.

Mass Rapes in Bosnia-Herzegovina illustrated the structural sexual violence in war and made it hypervisible. Despite the fact that 111 cases involving sexual violence during the war are being heard in the court of Bosnia and Herzegovina only thirty-six cases have been completed. Sara Sharratt’s theory argues that all institutions in society including the courts are affected by the stereotypes and prejudices that are prevailing in society, of women and sexual violence between the genders. She argues that the society puts labels on rape victims based on prejudices. These prejudices affect the court members and thus the court judgments.
The aim of this essay, by using a critical discourse analysis was to examine how women and the sexual violence against them during the war are presented in five of the completed verdicts against war criminals convicted for sexual violence under the categorization of Crime against Humanity. The analysis of the verdict showed that the discourse directed a lot of focus towards the women instead of the perpetrators. The courts members applied the shame and humiliation label on the victims of sexual violence. According to the verdicts the women did not get raped on the basis of their gender, only on the basis of their ethnical or religious identity which shows us that the court is not gender-sensitive.
