- Det allmänna preferenssystemet GSP är ett av EU: s viktigaste unilaterala handelsavtal som ingås med utvecklingsländer. För att gynnas av behandlingen måste länderna uppfylla särskilda kriterier. Ett av villkoren är ratificering och effektiv implementering av ett antal internationella konventioner om mänskliga rättigheter. Bland dessa ingår Internationella arbetsorganisationens (ILO) internationella standarder. Historiskt sett har de internationella standarderna och mänskliga rättigheterna i GSP-förordningen inte haft en särskild stark ställning. Förändringen innebar bland annat att länderna kunde få ytterligare förmåner om de uppfyllde nya kriterier som EU hade uppställt. I de fall då kraven inte uppfylls, kan det bli aktuellt med ett tillfälligt upphävande av förmånsbehandlingen. Denna uppsats undersöker EU:s tillämpning av de grundläggande mänskliga rättigheterna i det allmänna preferenssystemet genom granskningen av ett antal klagomål som har rört ILO:s internationella standarder men även FN:s grundläggande konventioner om mänskliga rättigheter. - The Generalised Scheme of Preferences (GSP) is one of the EU’s most important unilateral trade measures which grants tariff preferences to developing countries. In order to receive this preferential treatment countries are required to fulfil specific criteria. One of the conditions is the ratification and effective implementation of a number of international human rights conventions. - The Generalised Scheme of Preferences (GSP) is one of the EU’s most important unilateral trade measures which grants tariff preferences to developing countries. In order to receive this preferential treatment countries are required to fulfil specific criteria. One of the conditions is the ratification and effective implementation of a number of international human rights conventions. Among these, the international standards covered by the International Labour Organisation (ILO) are included. Labour standards and human rights have historically not had a strong position in the EU’s GSP. However, with each review of the GSP progress has been made; especially after the WTO ruled in the EC-Tariff Preferences case that India filed in 2002 and which pushed the EU into adopting a new GSP under an improved system. The new regulation entailed that beneficiary countries could benefit from further preferences if they could fulfil the positive conditionality aspect which the EU has set up. In cases where the requirements are not fulfilled, a temporal withdrawal of preferences may be relevant. This thesis examines the enforcement of human rights in the European GSP by investigating a number of complaints which have concerned the alleged violation of ILO’s core labour standards and the fundamental UN conventions on human rights which are included in the GSP.
