Abstract (Swedish)
This essay contains a critical discourse analysis of the UN document Handbook for legislation on violence against women from 2010. The critical discourse analysis is conducted from a critical feminist perspective and the focus has been on the identified subject positions. I further examined how the criminal legal subject’s and the subject of criminal responsibility’s gender are discursively constructed in relation to the children and the stakeholders. I examined the gender constructions from an intersectional perspective. By this I have concluded that women and men with specific qualities are more likely than others to obtain protection and be punished from the proposals in the document. I found that the reason for the stakeholders to obtain a subject position at all is because they discursively are attributed with the responsibility for protecting the criminal legal subject and that the discourse of responsibility makes some actions visible while some become invisible. I also found that responsibility dis-course attributes to stakeholders that cannot be legislated into existence much responsibility, which entails the abolition of protection cannot be reached by legislation.
